Democrats Announce They Won’t Use “Deem And Pass”
After a week of debate over the process behind passing the potentially historic health care legislation before them, it appears that the Democrats in the House will now not be using the “deem and pass” method to move the bill through the house. Representatives Steny Hoyer and Tom Clyburn just announced to the press on Capital Hill that they expect to have the votes to pass the Senate bill deeming the “deem and pass” tactic unnecessary to pass the bill.
CNN’s Jeffrey Toobin: Supreme Court Will Not Overrule ‘Deem and Pass’
Bad news for Republicans should they be counting on using the Supreme Court as a last resort to block the Senate health care reform bill. Jeffrey Toobin visited Rick Sanchez today to talk about the chances of success Republicans will have if they try to legally oppose a “deem and pass” vote that would indirectly put the bill on the President’s desk, and he didn’t waste any time in telling the GOP that, quite simply, it’s not going to happen.

At yesterday’s White House briefing, the hot topic du jour was the House Democrats’ procedural “Deem and Pass” maneuver, also known as “Demon Pass,” the “Slaughter Rule,” and if I’m not mistaken, the “Cider House Rule?” I’m not sure about that last one.

Yesterday saw the unveiling of House Speaker Nancy Pelosi’s hinting at a new strategy to get the health care reform bill railroaded in Congress: The “Deem and Pass” rule.
But MSNBC’s Chris Matthews takes issue with this plan: If the Democrats avoid a direct up or down vote on the bill, they would expose themselves to criticism of “pulling a fast one,” by allowing members of Congress to claim they didn’t support the reform bill in its entirety, and thereby avoid having to answer for their votes.

That didn’t prevent CNN’s Ed Henry from pressing Gibbs later in the briefing, in a textbook example of what White House reporters should do. Although he didn’t exactly get a straight answer, sometimes the non-answers can tell you something, too.
