Florida Federal Judge Rules Entire Healthcare Law Unconstitutional

Today in a Florida Federal Court, a major blow was dealt to President Obama’s healthcare reform bill. Judge Roger Vinson ruled that it was unconstitutional for Congress to require all Americans to purchase health insurance, however even more devastating, the opinion went on to say that “because the individual mandate is unconstitutional and not severable, the entire Act must be declared void.”

On Fox News, Shepard Smith and Judge Napolitano discussed the implications of today’s decision, and how Shep was convinced this was major news since he had never before seen so many urgent news alerts related to one subject appear on his computer screen. Given that today’s decision involved governors and attorneys general from 26 states, today’s decision is certainly significant. With today’s decision, now two lower courts have ruled the healthcare bill constitutional and two have ruled it as beyond the scope of what Congress has the power to enact.

Yet all roads lead to the Supreme Court, and Napolitano predicts it will be ruled on by the Supreme Court in about three years, which is definitely shaping up to be a hugely anticipated case and quite possibly the most political one since Bush v. Gore in 2000.

    Yes, this bill is unconstitutional.
    However, the real reason to eject this bill is because is is BUTT UGLY bad!!!

    First, this bill was more about controlling the economy than about health care.
    Second, those perpetual Democratic talking points could have been solved in a 3 page bill. So what do you think the other thousands of pages are about?

    They’re basically choosing to “opt out.” So let them opt out of medicare as well, which is not constitutional.

    If this law is unconstitutional, so is, VA healthcare, Medicare and Medicaid.

    All of us are now or have been forced to pay for these healthcare programs whether we ever use them or not.

    In fact, there are millions of Americans who paid for Medicare coverage for 35-40 years but died before they ever used it. So to all of you tea partiers on Medicare, be careful what you’re asking for.

    It doesn’t really matter except when counting legal points to argue. Without the mandate, the rest of the law is a moot point due to lack of funding.

    This is the first time that a Fed judge ruled the ENTIRE bill was unconstitutional. The others were decisions on the mandate to buy insurance.

    Sounds like in addition to thinking it will ultimately be ruled Constitutional that you probably think it’s Constitutional.

    Here’s the 10th Amendment: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

    So, given how adamantly that says that everything but the enumerated powers is off limits to the feds, they have NO powers outside what is explicitly granted to them.

    So, if the 10th Amendment is real, in your eyes, WHAT LIMITS ACTUALLY EXIST ON THE FEDERAL GOVERNMENT?

    Both sides have dropped the ball big time over the years when it comes to coherent health care policies. The judge did not say the current law was unconstitutional per se – only the individual mandate is and since it is so integral to the whole the entire law does not pass muster. Had Congress passed a single payer version of the law then most of the arguments against it would go away. I for one never want to be told by the Federal government I must engage in an activity just so they can regulate it.

    The problem is if the government can’t collect any money until the Supreme Court rules then the budget tricks used to show how the law was paid for over a ten year period are wiped out. The intent was to collect money for ten years and pay out out for only six. If they only can collect for six then the impact on the deficit is negative by tens of billions instead of positive.

    Medicare is not mandatory. You can choose to opt out of Medicare but if you do and then attempt to carry your own insurance you may find that most companies would not insure you. Medicaid is not mandatory. If you are poor enough you must apply for it. VA healthcare is also not mandatory.

    In ruling against President Obama‘s health care law, federal Judge Roger Vinson used Mr. Obama‘s own position from the 2008 campaign against him, arguing that there are other ways to tackle health care short of requiring every American to purchase insurance.

    “I note that in 2008, then-Senator Obama supported a health care reform proposal that did not include an individual mandate because he was at that time strongly opposed to the idea, stating that ‘if a mandate was the solution, we can try that to solve homelessness by mandating everybody to buy a house,’” Judge Vinson wrote in a footnote toward the end of the 78-page ruling Monday.

    People a lot smarter than you and me have taken all this into consideration. It’s been known since the bill was passed that whether or not the bill is constitutional will be settled in the Supreme Court. I’m really not concerned about it.

    Nice fear mongering. The Emergency Medical Treatment and Labor Act (EMTALA) has been around since 1986. It requires hospitals to provide treatment to anyone at an emergency room, regardless of insurance or ability to pay.

    I live in Maine (yeah I know) and I helped elect the new governor (R) and his largely republican cabinet and legislature. The first action he took was to join the national lawsuit against Obowmao care. The left in this state have been going nuts and the bias in the local rags and state run media has been fun to watch. You might know him, he recently told the NAACP to kiss his ass.

    Point being, this is great news and Gov. LePage was right out there today making a public statement about the Florida finding. There may be hope. O/T read today the TP is threatening to run against Senator Snow RINO!!

    Find some of these children and sponsor them. You foot the bills. You help raise money. It is people like you that expect government to support them and everything else that the disadvantaged cannot afford. Some are disadvantaged due to their own actions! And then people like you expect government taxpayers to treat them all equally. That is wrong and it is a disincentive to taking care of yourself, or taking care of others, because more and more everyone expects the government to do it for them.

    Congress has exceeded its authority since the passage of the 17th Amendment in 1913, and with the egregious and overreaching abuse of the commerce clause that was unleashed without restraint in 1942 with Wickard v. Filburn.

    The real function of the interstate commerce clause is so the feds can ENFORCE CONTRACTS entered into by mutually agreeable parties. The private parties decide the terms, and the feds hold the parties to their contractual commitments. The feds were NEVER supposed to dictate the terms.

    The biggest cause of the abuse of Federal power can be traced back to one liberal hero, FDR. It was his court packing cronies that gave the commerce clause an endless amount of unconstitutional authority. “Legislating” for the “common good’, and ‘general welfare”, becomes anything liberals want to ram through their liberal courts. And the sheep haven’t a clue, or care until it affects them. And only then will they bleat, or applaud.

What they fail to recognize, but which anyone with a clue can spot a mile away, is that they are clueless and dismissive of the founding principles of this country, and how lost we are without those principles. To paraphrase Mr 0bama, we are: “no better, or no worse than any other country” without those principles!     Apparently, the Florida judge’s decision is legally binding on the Hussein regime who must shut down implementation of CommieCare pending appeal of the ruling. But predictably, Hussein and his gang have stated they have no intention of obeying the law, and will keep moving forward with their evil regardless of what the federal judge says. Interesting.

    What happens when Hussein Soetoro simply chooses to ignore other laws and just remain in power ala Hugo Chavez?

    Did they state that? I only read that they intended to get a legal waiver of the ruling from the next higher court which they have a legal right to try to get.
