A conservative legal group ran by former Trump adviser Stephen Miller filed a complaint against Macy’s just before the Thanksgiving Day parade, claiming the company is hiring employees based on a race and sex.
America First Legal, which previously sued Target over LGBTQ products, said in a complaint to the U.S. Equal Employment Opportunity Commission on Tuesday that Macy’s employment practices have “explicit racial and other quotas” that likely violate the Title VII of the Civil Rights Act of 1964.
Miller’s group cited a five-point diversity plan drafted in 2019 that aimed to achieve “more ethnic diversity by 2025 at senior director level and above, with a goal of 30 percent,” according to Newsweek.
Moreover, the retail giant allegedly wanted to create a 12-month program “to strengthen leadership skills for a selected group of top-talent managers and directors of Black/African-American, Hispanic-Latinx, Native American and Asian descent,” AFL claims in their complaint.
AFL labeled Macy’s hiring practices as “patently illegal” adding that the company “has only reinforced its commitments to recruitment and hiring policies that likely violate federal law.” The conservative group is aiming for the EEOC to punish Macy’s with a “commissioner charge.”
In a letter sent to the company’s chairman and board of directors, AFL accused Macy’s of “mismanagement that threatens the waste of company assets, institutional disregard for and violations of federal civil rights laws, and breaches of fiduciary duty.”
Meanwhile, the legal group outlined the details of their complaint on X, formerly known as Twitter, informing supporters that Macy’s is “denying career advancement to white straight men.”

“Macy’s own public-facing materials all but acknowledge that they are engaging in personnel practices that violate federal law,” John A. Zadrozny, an AFL representative, said in a statement. “Because of this, Macy’s is now going to have to explain to the Equal Employment Opportunity Commission why they have chosen to become a civil rights violator. It is our hope that Macy’s takes this opportunity to correct its unlawful and egregious conduct as soon as possible.”
