The Supreme Court declined to hear an appeal from New York Times reporter James Risen, who was seeking to overturn a 2013 ruling compelling him to testify in a case about information that may have been leaked by a CIA officer for his book State of War.
CIA officer Jeffrey Sterling was indicted in 2010 on multiple charges related to information contained in Risen’s book.
Prosecutors want Risen’s testimony in the case. Risen argued for a “journalist’s privilege” under the First Amendment, but the 4th Circuit Court of Appeals refused to recognize the privilege. SCOTUS’ rejection of the case means the previous ruling compelling Risen to testify stands.
