Fox’s Napolitano: Hillary Could Potentially Face Jail Time if Charged over Emails

Fox News’ Judge Andrew Napolitano said this morning that if Hillary Clinton is charged with a conspiracy to conceal her emails from government computers, she could potentially face jail time. Of course, he didn’t say it was terribly likely this would happen, but Napolitano called Clinton’s actions “potentially criminal.”

Napolitano compared this case to former CIA chief David Petraeus pleading guilty this week to, as the DOJ put it, “unauthorized removal and retention of classified material.” Napolitano argued that Clinton “must have had classified secrets” on her home server and could get in trouble along the same lines.

There’s also, he added, the potential issue of “conspiracy to deflect documents, to conceal documents from government computers,” and if she’s prosecuted on that, it would be “grave for her political future.”

As for Clinton’s tweet calling on the State Department to release the emails, Napolitano only had this to say:

“She doesn’t need the State Department to release the emails. She has the server. She has the emails. She can release them. She won’t do that.”
