Fundamentalist muslims are in the same category as a lot of right-wingers in this country anyway: both hold the same conservative beliefs (social conservatism, anti-governmentism) and the concept of clash of civilizations. If Hasan had been a fundamentalist Christian, I wouldn’t have judged him any differently from how I judge him right now.

I honestly have not heard a commentator who has said “Go after all Muslims.” What they have said is that the media is willing to look for anything that might explain these actions apart from declaring he was in fact a Muslim extremist. The press has declared Hasan was stressed. They said that he was reluctant to go to war (but not reluctant to replicate the horrors here at home). And the best was that he somehow contracted post-traumatic-stress disorder from other soldiers. While making that leap they overlooked all the blatant signs Hasan had been giving that he was in fact a Muslim extremist.

The irony is that people who have called Hasan anything but a Muslim terrorist are the same ones who say I just do whatever Beck and Limbaugh tell me to do, because they disagree with something I said. In other words, “Don’t judge the guy who shot nearly 50 soldiers, while I judge you as a moron who has to have someone think for you!”

Yea, except I saw where Hasan tried to contact Al Qadea – on ABC News. And he was combative about his faith and had been diciplined for he outlandish views on the war — according to Yahoo.news.

It’s amazing that Bill — or should I say, Mr. Adkins, Esq. — would use his calling card as his icon when his comment reveals that despite his ability to pass a bar somewhere in America, he can’t be counted on to do research before he opines. I’m just a layman, but I always thought that was important for lawyers to do well.

FACT: Neither Beck nor Limbaugh has ever said anything that comes close to “kill all the muslims and let god sort it out” or “declar[e] war on ALL muslims.” Counselor Adkins’ alleging this is their outlook out of his ignorance is one thing, but it’s reasonable to presume that Adkins at least watched the video clip provided in the thread. Beck made no such allusion in the video, but nevertheless that’s what Adkins took away from it.

IMHO, that’s intellectually lazy, not a quality you want in an attorney. Who’s the “simplistic” one? Not Beck.

@TfT: I’m not sure that I understand the meme that’s been going around, but I don’t believe contacting Al Qaeda (if such a thing was possible) is a crime. It might not be the prudent thing to do and if you were to contact someone under surveillance, you’d probably be labelled suspicious, but calling somebody on somebody’s list shouldn’t be a crime.

Glenn Beck has no obligation to afford Hasan “due process” or any “presumption of innocence.” He is a talk show host, not the government. The reason we demand that the government prove a case beyond a reasonable doubt, for example, is because it has the power to take away someone’s frredom. Due Process, in the legal sense, is not an obligation hoisted onto talk show hosts or journalists for that matter. Glenn Beck may be powerful but he can’t put someone in prison.

He is entitled to his opinion and in this instance, I happen to agree with much of what he said.

@L.n. Smithee: Explosives are regulated and contacting a suspicious person should raise suspicions, but making it illegal to contact an individual seems impossible, if not unconstituational. I mean, who gets to determine who is al Qaeda and are they going to require them to send a registered letter to everyone who might contact them, now or in the future?

Under Bush’s Executive Order, the Secretary of State can add a terrorist group to the watch list in consultation with the Attorney General and the Secretary of the Treasury. This allows the government to seize the group’s assets and it makes it illegal to do business or provide support to the group, but there’s a defined process for a group to be named and they can appeal their designation in court.

Again, though I agree that a suspicious contact should raise suspicions, I’d have a real problem with it becoming illegal for an American citizen to contact anyone, let alone another American. (The guy in question may have renounced his citizenship or something, but he was reportedly born in New Mexico and had lived in several states)

And you’d think that someone who follows Glenn Beck would feel the same.

Does that mean you have no problem with an officer in the Army contacting the enemy of his own personal accord? @MartiniShark: Again, I agree that he should’ve been investigated, when the authorities intercepted his email, but I can’t think of a circumstance where the simple act of emailing someone would be a crime.

As for your example of a soldier contacting the enemy (which is sort of this case): If the soldier gives secrets, they should be tried and convicted of the crime. Otherwise, it may be against Army regulations, but it’s probably not a crime.

That sounds somewhat like an equivocation. He contacted the enemy but we should wait until he gives them dangerous info to take action? You can be engaged in criminal activity without actually committing the crime, that is why you can be charged with “Attempted” crimes.

@MartiniShark: This is way off-topic for Glynnis’ post, but you have to actually commit a crime or attempt to do so, before you can be arrested. All accounts are that the FBI decided this particular guy’s emails were benign. Maybe they dropped the ball and it sort of looks like they did, but clearly with only the emails, he didn’t commit a crime.

It shouldn’t take a crime for law enforcement agencies to take action to prevent what could be reasonably presumed to be a prelude to a terrorist act. Otherwise, what would be the big deal with indicted potential terrorist Mohammed Zazi going to beauty supply stores sucking up all available quantities of nail polish remover to extract acetone? Remember, his cover story was “I have a lot of girlfriends.”

As I said before, as Islamists take advantage of simple, frivolous freedoms in order to sow fear and chaos, life and the law must adapt to protect the public. That citation of Chris Matthews’ fatuous question was made to illustrate the way the MSM has by-and-large gone into COA (Cover Obama’s A) mode by pretending the preponderance of the evidence doesn’t suggest Hasan was motivated by a jihadist mindset, instead asserting Hasan “snapped” or “cracked” under pressure the Army should have recognized. Thrill-up-my-leg’s question was designed to mitigate the logical presumption about Hasan as evidence continued to pour in about his contacts with Muslim radicals and shouting “Allahu Akbar” as he strafed unarmed people with bullets.

Because the only time in recent history I remember anyone wanting to actually ammend or re-draft the Constitution was Bush and the Reoublicans in 2004 to restrict marriage to two people of the opposite sex.
