Newt Gingrich Calls For Obama To Withdraw Kagan Nomination

If it’s up to Newt Gringrich the Elena Kagan confirmation process will not be a smooth one. On Fox News Sunday this morning, Gingrich took the right’s main opposition to Kagan — namely that she tried to restrict military recruiters’ access to Harvard campus based on her opposition to DADT — one step further, calling for President Obama to withdraw Kagan’s nomination.

The very fact that she lead the effort which was repudiated unanimously by the Supreme Court, to block the American military from Harvard Law School…we’re in two wars and I see no reason why you would appoint an anti-military Supreme Court justice, or why you would nominate and anti-military Supreme Court justice, or why you would confirm an anti-military Supreme Court justice.

Even Chris Wallace seem less than convinced by Newt’s opposition to Kagan: “Do you think you will really get a better nominee [than Kagan] out of Obama?” Newt wasn’t eager to answer that one. Of course, I’m not sure Newt is terribly interested in much here beyond being the person to generate the opposition headline, such as it is. Video of the segment below.

    I find Kagan’s decision to restrict military recruiters’ access to Harvard campus based on her opposition to DADT, a policy instituted by Bill Clinton, to have been deplorable, but I want to hear her address it .

    Considering the other liberal losers BHO could have nominated, Kagan seems fairly unremarkable.

    Newt is wasting his time. He should realize that Obama could withdraw the Kagan nominee, but his replacement choice won’t be any better. There are two types of judge: those who base their judgments on the law and those who base their judgments on their personal opinions. Obama is clearly aligned with the second group, so even without Kagan we will still get an appointee who will try to legislate from the bench.

    As far as Kagan goes….I’m cool with seeing how she responds to the Judicial Committee questions. It’s an appointment for life and there are a lot of questions that need to be asked.

    Personally, I’d like to ask if she would be willing to write her own opinions rather than a group of law clerks writing for an octogenarion whose time has passed by. She’s a blank slate…that’s not necessarily a bad thing.

    A justice should be bound by the rules of existing law. The Supreme Court is the Court of final appeals. A Legislature can always craft new law…it works for both sides.

The Soon-to-Be Justice Kagan was upholding university policy, and when the legality of that policy was put to question, Kagan made the appropriate change. The fact that she shows respect for law and policy, unlike Justices Alito, Scalia and Thomas merely undrescores her suoitability.

    Newt is playing a little political strategy here. Yes, Kagan will most likely be confirmed, and as far as potential justices go, she’s (apparently) isn’t the most ideological person Obama could have picked. By Newt bringing up the DADT decision by Kagan, he can attack her philosophy, but more aptly, attack Obama’s. While DADT is fairly evenly split, the support for the military is still very high… and when framed as “an attack on our military in a time of war,” Newt can attack Obama’s military record.

    It’s strategy. Not necessarily dishonest… but certainly opportunistic (if Newt was in Congress, he probably wouldn’t have said this).

    What a joke you are. The policy wasn’t “put to question”, she signed on to an amicus brief that went to the SCOTUS and there the court found unanimously against that brief and ruled that the Solomon Amendment was constitutional and that schools had to allow recruiters on campus.

    Stop your lying liberal ass now!

    And show just where Justices Alito, Scalia and Thomas have not shown respect for the law and policy.

    What a load of nonsense. Of course your opinion determines how you VIEW the law. Even Scalia and Thomas have personal opinions that shape how they view and interpret the constitution. There is no intellectually neutral person on this earth. I totally agree with Supreme Court Justice Kennedy when he says an activist court is one that makes a decision you do not agree with. Liberals will call conservative judges “activist” and vice versa.

    Other options exist. I “think” they can render judgements without it being adjucated….in other words, I think, they can send an appeal back to the appelate court with an opinion.

    That “response” can provide a foundation for a future appelate appeal.

    Or an appeal can be dismissed without any argument.

    My point is…I do believe the checks and balnces work. Good sign of democracy.

    Sad commentary on the Left that they don’t even understand the difference between judgments based on the Constitution and judgments based on personal opinion. But that is part of the lack of symmetry between Right and Left. If the Right controlled the court, the Constitution and the Bill of Rights would rule the day. If the Left controlled the court, their personal opinions would be substituted for the Constitution and the Bill of Rights. And the Left is so corrupted that they don’t even recognize the difference any more.
