JUST IN: Supreme Court Delivers Win to Trump That Gets The Ball Rolling On Curbing Mail-in Ballots
The Supreme Court ruled 6-3 on Monday that part of Donald Trump’s executive order to restrict mail-in ballots can move forward, in a win for the president.
Under the ruling, the Department of Homeland Security can gather lists of people in each state it deems eligible to vote. This includes the Democratic-led states that signaled they would not comply by suing the administration.
In addition, the U.S. Postal Service will be allowed to impose new mandates on states that want to mail out ballots. First, those states will need to submit their own lists of eligible voters to DHS.
According to CNN, “The justices gave USPS the green light to implement that aspect of Trump’s plan, but a lower court blocked that effort nationwide in a separate case. That means more court action will likely be needed before the USPS can move forward.”
On Monday’s The Lead With Jake Tapper, fill-in anchor Bianna Golodryga said, “It’s worth noting that this decision did not address the legality of Trump’s order, only the timing of the challenge to it. Nonetheless, Kristen [Holmes], this is a big win for the president, who we should note, votes often by mail as recently as earlier this month.”
“That’s right,” said Holmes, reporting from the White House. “And he usually, when he’s talking about voting by mail, particularly around a time frame in which he himself has voted by mail, he talks about the exceptions that would be in the Save America Act. And one of them is travel, which he leans heavily on, given the fact that he is president of the United States and he continues to vote by mail.”
Holmes continued:
Part of what you’re seeing here is basically an allowance of the court for this unique and really unprecedented federal oversight into the election system. This is something that has usually been really just controlled by the states, but by bringing in DHS, by bringing in the Postal Service, you are bringing in federal entities here. And that is something that President Trump has long wanted, some kind of federal component to the election system. How this is going to play out…we really don’t know at this time, but it certainly seems as though they’re going to kick this into high gear to start the process. Now, when it comes to the Postal Service, for instance, there was another ruling and another lower court that had put this on hold as well. So there’s going to be more legal hurdles before this can go directly into effect.
