Fox’s Cavuto Says ‘It Doesn’t Look Good For the Former President’ In Fraud Trial
Fox News Anchor Neil Cavuto took a dismal view of Donald Trump’s chances in his civil fraud trial when he claimed Monday that “it doesn’t look good” for the former president.
Cavuto discussed the case with defense attorney Katie Cherkasky and former Department of Justice official Tom Dupree.
“Katie, where I have trouble — and you guys are both the legal experts — but why and how this could take three months?” Cavuto asked. “The judge has already ruled, certainly in the case of Mar-a-Lago, the president’s home and primary property in South Florida, was way overvalued. So he’s already stated that being the case. There’s no jury. So short of him doing a 180 and changing his mind on any or all of this, it doesn’t look good for the former president. What do you think?”
“Well, I would say that the prior ruling on the summary judgment is not a good omen for the rest of the case,” Cherkasky said, continuing:
But there are still additional counts that Letitia James’ side has to prove, including conspiracy and intent to defraud. Because the ruling that he made in that pre-trial motion for summary judgment was essentially limited to whether the entries were fraudulent based upon the valuation of those properties as the judge saw it.
So there’s quite a lot of real estate properties that they have to go through and there’s quite a lot of witnesses that have to be testifying. So, all of the conspiracy counts still have to be adjudicated and then the ultimate determination about financial penalties has to be determined as well. So even though there was that very significant pretrial decision about the entries, there’s still other questions to be resolved at trial.
Trump’s attorneys did not request a jury trial, meaning it will be entirely up to Judge Arthur Engoron to decide the outcome of the case. The New York attorney general’s office is seeking $250 million in penalties and a ban on Trump and his adult children Donald Trump Jr. and Eric Trump from conducting further business in New York.
