ABC has filed a First Amendment lawsuit against the FCC — accusing it of waging a “retaliatory campaign” because it “disapproves” of what it broadcasts.
The lawsuit, filed in U.S. District Court in Washington D.C. early Tuesday, alleged that President Donald Trump’s administration is using the FCC to seek revenge against ABC in violation of the network’s First Amendment rights.
“Acting through the Federal Communications Commission, the Administration has waged a retaliatory campaign against ABC for a single reason: it disapproves of what ABC broadcasts,” the lawsuit states (via Deadline).
FCC chairman Brendan Carr announced in February that he started “enforcement proceedings” against The View for potential violations of the “equal time” guideline. And the FCC, in April, announced an investigation into Disney, ABC and its subsidiaries “for possible violations of the Communications Act of 1934 and the FCC’s rules, including the agency’s prohibition on unlawful discrimination.” That announcement immediately followed a joke made by ABC late night host Jimmy Kimmel about Melania Trump being an “expectant widow.”
ABC, in a July filing, accused the FCC of “attempted censorship.”
“The retaliation against ABC is a signal to every media company in the country: accommodate the Administration’s view of what news coverage should look like or pay the price,” the network said in the filing.
