Judge Napolitano Hits Devin Nunes For Acting Like a Political Operative: ‘I Question His Seriousness’
Fox News legal analyst Judge Andrew Napolitano went after Rep. Devin Nunes (R—CA) on Thursday, after the lawmaker threatened to subpoena the FBI and Justice Department for the original documents the agencies used to kick-off investigations into Russian interference in the 2016 election.
Nunes, the chairman of the House Intelligence Committee, requested non-redacted versions of four Federal Intelligence Surveillance Act (FISA) applications from the DOJ and a document from the FBI, claiming the redacted version of the file he requested was covered in blackout marking and did not provide enough material to aid his committee’s probe. He also threatened legal action against Deputy Attorney General Rod Rosenstein and FBI Director Christopher Wray‘s agencies, should they not meet his deadline of April 11 to submit the documents.
But April 11 appears to be too far away for Napolitano’s liking.
“I question his seriousness for two reasons,” the judge said Thursday on Fox News. “His reason for wanting to examine the documents that initiated the investigation of the Trump campaign in October 2016 is because of a well-grounded belief they were obtained via a FISA warrant and he wants to know what was presented to the FISA court to get them to issue the warrant. His complaints are FISA are very well-grounded. But he remained mute about them when Congress voted to expand FISA authority.”
Napolitano encouraged Nunes to enforce a subpoena against Wray — something the representative already said he was planning on doing by April 11 — and then hold him in contempt if he failed to provide the non-redacted version of the requested material. Or, better yet — call President Donald Trump himself.
“If his goal is to score political points he is making a lot of noise, but if he wants to get the documents he knows how to get them,” Napolitano continued. “There is another way to seek the truth. Call up the president. We’re both in the same political party. You were the victim of this investigation. We’re trying to get to this. Call up Jeff Sessions and have him call up Chris Wray and tell him to cough up the documents.”
