Trump White House Lawyer Rips Aileen Cannon’s ‘Incompetence’ in Docs Case: ‘Should’ve Started Trial Yesterday’
Ty Cobb re-upped his broadsides against U.S. District Judge Aileen Cannon after a long day of proceedings in Donald Trump’s government documents case.
On Wednesday, Cannon – a Trump appointee to the federal bench in 2020 – presided over what media reports said was a shouting match between prosecutors and attorneys for the former president. Trump is charged with retaining classified documents after leaving office obstructing their retrieval by the government.
Trump and co-defendants Walt Nauta and Carlos de Oliveira all filed a motion to dismiss, stating that the indictment suffers from technical flaws. All three men have pleaded not guilty.
Cannon did not rule on the motion, but said she is concerned that a jury might not be able to understand the intricacies of the case.
Cobb, who served as an attorney in Trump’s White House, scoffed at the idea on Wednesday’s OutFront on CNN.
“I think most jurors will have a triple-digit IQ,” he said. “And that’s probably not familiar territory for Judge Cannon. But I don’t think they’ll have the difficulty that she perceives.”
“So, Ty, this was the first time we heard from Judge Cannon since she indefinitely postponed the trial – first hearing devolved into a shouting match as we were just saying… Do you think there’s any possibility that this case moves at all? I mean, there’s no trial date now. She’s made that formal.”
“No, I don’t think this case will move at all,” he replied. “And I think the fact that she’s scheduling hearings, multiple hearings, sort of one or two motions at a time is compelling evidence of that. Most federal judges would have long ago ruled on all the pending motions. And frankly, this is a case that should’ve started trial yesterday or two days ago when the original trial date was set. This case could have easily gotten to trial. Only her incompetence and perceived bias has prevented that.”
Cobb has perhaps been Cannon’s fiercest critic. Earlier this month, he said Cannon is “not capable of ruling intelligently” in the case. Last month, he said Cannon should be removed from the case altogether. In March, he called her decisions “embarrassing,” “baffling,” and “unhinged.”
