Trump’s Former White House Lawyer Absolutely Destroys ‘Wholly Unconstitutional, Authoritarian’ Case Against Comey

 

Attorney Ty Cobb, a former member of President Donald Trump’s White House legal team during his first term, said he does not “see any way in the world” that ex-FBI Director James Comey is convicted — before blasting his former boss for going after Comey in the first place.

Cobb, during an appearance on Face the Nation on CBS on Sunday, made it clear he is not betting on President Trump’s rival going to prison. He also ripped Trump for the “wholly unconstitutional, authoritarian way” that his Administration went about indicting Comey this past week, saying the details lead him to believe Comey will walk.

Here is what he had to say when host Margaret Brennan asked if there was “enough substance” against Comey to go to trial:

“I don’t, really. You know, as you can Senator Kaine discussed briefly, moments ago, that the grand jury rejected one of the counts, the top count, actually, in the indictment, approved two, but by a very slim margin — 14 out of 23 in a process where there’s no defense attorney in the room and the standard is merely probable cause. The next courtroom that this will be assessed in, if it gets to trial, requires unanimity from 12 people, and there will be a vigorous defense. I don’t see any way in the world that, you know, Comey will be convicted. And I think there’s a good chance, because of, you know, the wholly unconstitutional, authoritarian way that this was done, that the case may get tossed out well before trial.”

That answer appeared to surprise Brennan. She pointed out Cobb used to work for Trump — which made him quickly note he was not a personal attorney for the president, just more of a “government employee” who served on the White House legal team from mid-2017 to May 2018.

Brennan then asked him to explain why he characterized the Comey indictment as “unconstitutional.”

In a long reply, Cobb explained Nuremberg Trials prosecutor Robert H. Jackson argued it was paramount that the Justice Department “merely pursue crimes” and not individuals. But that is not what Attorney General Pam Bondi is doing currently, Cobb said; instead, the government is going after Comey because Trump hates him, Cobb said.

“I think we talked about the misrepresentations that Attorney General Bondi made about how she would proceed even-handedly, and, you know, she’s wholly abandoned that and is now merely doing the president’s bidding when he says, prosecute my enemies, now,” Cobb said.

His Face the Nation interview comes after Comey was indicted by a grand jury on Thursday in the Eastern District of Virginia. Comey was indicted on one count of making false statements and one count of obstruction of justice tied to Senate testimony he gave in 2020.

Those charges came less than a week after the president urged Attorney General Pam Bondi to take “action” against Comey and other political rivals, like Sen. Adam Schiff (D-CA).

Trump has ripped Comey and Schiff in the past for pushing what he called bogus claims he colluded with Russia to win the 2016 election. The president, in 2023, called Schiff a “sleazebag and traitor” who “should be prosecuted for the damage he has done” to the U.S. Trump has criticized Comey a number of times for leading what he has called the Russia “witch hunt” over the years.

The president, soon after Comey was indicted, celebrated the move.

“He has been so bad for our Country, for so long, and is now at the beginning of being held responsible for his crimes against our Nation,” Trump posted on Truth Social.
