‘Foolish’: Fox’s Andy McCarthy Condemns Trump DOJ Pursuing a Case Against Comey

Fox News’ Andy McCarthy, the conservative commentator and former federal prosecutor, came out against the Trump administration’s prospective prosecution of ex-FBI Director James Comey during a Thursday America Reports segment.

MSNBC’s Ken Dilanian and Carol Leonnig reported on Wednesday that Comey is “expected to be indicted in the coming days.” That reporting followed a Truth Social post fired off by President Donald Trump urging Attorney General Pam Bondi to prosecute Comey, Senator Adam Schiff (D-CA), and New York Attorney General Leticia James (D) over the weekend.

On Thursday, anchor Molly Line asked McCarthy, “What do you think of this? What do you think is going to happen?”

“Well, there’s obviously a lot of pressure to bring an indictment. We saw that over the weekend. I hope there’s not an indictment. I think, you know, the people who’ve looked at this, Molly, so far, it’s not like a bunch of Biden or Hillary Clinton prosecutors have gotten together and sort of whitewashed this thing. Not that I think they have much use for Comey either, but these were people who actually Trump hand selected people who looked very hard at this case, and tried to make it and decided that they didn’t have the case,” replied McCarthy. “I think there’s a lot of good reasons for that; perjury case is a very difficult case to bring. So I’m very suspicious that there’s nothing there, but obviously they want to please the boss.”

Line then played a clip of Trump talking about the matter earlier that day.

“I can’t tell you what’s going to happen because I don’t know. You have very professional people, headed up by the attorney general; they’re going to make a determination. I’m not making that determination. I think I’d be allowed to get involved if I want, but I don’t really choose to do so,” said Trump.

“Andy, what are your thoughts on that perspective?” inquired Line. “He’s arguing that he’s staying out of this.”

“Well, it’s hard to make that argument credibly given the post that he put out on, was it Friday or Saturday? But you know, look, he’s right. As a matter of constitutional law, he can direct the Justice Department. Now, it’s foolish for the White House to do that because I think the president is supposed to give direction in terms of what kinds of law enforcement priorities he has, but they really ought to let the day-to-day administration of justice in particular cases be done by professional prosecutors at the Justice Department,” answered McCarthy. “He says now that he’s going to let them make the decision. We’ll just have to see what happens.”
