Tea Party Member’s “Gotcha” Moment With Dem. Phil Hare: “I Don’t Worry About The Constitution”

St. Louis Tea Party activist and budding citizen journalist Andrew Sharp talked to Fox’s Neil Cavuto about his run-in with Democratic Representative Phil Hare, during which the young man got the Congressman to say on camera that he cares more about the lives of people than finagling over the finer points in the Constitution as it applies to the health care reform bill. “Jackpot baby!” Sharp says off-camera, and it is a misspeak on Hare’s part (though if you listen closely, he says he doesn’t worry about the constitution on this…” which could be construed as the Congressman saying that he doesn’t believe there is anything in the books saying the bill is unconstitutional) and yep, he does get the Declaration of Independence confused with the Constitution when he says “I believe everyone has the right to life, liberty, and the pursuit of happiness. After the Cavuto video, watch Hare’s response, in which he calls his own response to the “gotcha-type” journalism “out of context.”

    The problem with your “argument” is the Tenth Amendment. If the Constitution does not delegate a power to the federal government, it is reserved to the States, or to the People. Therefore, since the Constitution does not expressly grant the federal government jurisdiction over your bathroom habits, it is between you and your state government. That’s called federalism.

    Being that the halls of congress are filled with lawyers, I have no doubt that consideration was given to the legality of it. And with the presence of activist right wing judges on the supreme court willing to ignore precedent, I have no doubt that the potential exists for it being overturned.

    Here’s one of the top lawyers in Congress on the issue. John Conyers, the Chairman of the Judiciary Committee (who is a lawyer), was asked what provision of the Constitution empowered them to enact Obamacare. He responded: “the good and welfare clause”:

    Just to be clear, I think the Supreme Court will eventually affirm the Constitutionality of Obamacare. Writing on a clean slate, I don’t think that’s the right answer. But they are bound by precedent and during the New Deal the Supreme Court (under direct threat of being packed by FDR) eviscerated the Commerce Clause, most notably in a case called Wickard v. Fillburn. That’s why I like the Turley piece. He’s not predicting that the Supreme Court will rule it unconstitutional. He’s just saying that if then don’t, federalism is dead. He’s right.

    Turley is a good man. I haven’t seen him on Countdown for a while. He is due for an appearance.

    I agree. Turley is a good man. He’s not an ideologue; he calls them like he sees them; and he’s smart as hell. We need more people like him in the public sphere.

    I believe he use to appear on the Factor, but then once he started appearing on Countdown and he fell out of favor with Bor. Then then fans of Fox News started referring to him as Jonathon “Turdley”. But yes he has always given thoughtful, honest, opinions that weren’t necessarily what the audience wanted to hear.

    This is old news but I saw this ‘gotcha’ clip on Fox 2 or 3 days ago — and never was there a more obvious editing of a clip. The complete sentence as it trailed off indicated he did not believe there to be a constitutional problem with the legislation. Fox Not News and editing, so often together in their misinformatoin.

    I have just moved into Congressman Hare’s district and was going to attend this town hall that he was speaking at, but wasn’t able to. I like Congressman Hare, but he’s not a quick-on-his-feet person. I just watched a clip of him on the Colbert Report where he was featured in the “Better Know a District” segment, and Stephen Colbert got him to say that it was wrong to break the law in the 1800s to escape slavery by using the Underground Railroad. I did wince in embarrassment when he confused the Constitution with the Declaration of Independence. But after this incident, it doesn’t look like he’ll be back as Congressman come November.

    You’re an idiot. The congressman published a response to the video. Even he doesn’t claim that the video was edited improperly by anyone. Instead, he says people misunderstand what he was saying. Why are you so willing to bend over backwards to defend someone just because they have a “D” after their name?

I, however, watched the video on Fox when it appeared and it gave every indication it had been edited, a lame attempt to cut off the quote. Why are you so willing to bend over and kiss anyone’s ass who might take a shot at a Democrat?

    Anyone can look good if they get a do-over. Hare-brain is no exception. It is clear to the world that he thinks it’s OK to trash the Constitution and it’s a fair bet that he never read the -0bamacare bill that he signed off on.

    I will admit that I have only read about 550 pages (I wish I had more time to devote to doing so), but I can tell you that this is probably the most poorly written piece of legislation that I’ve ever encountered. What I find most troubling is that the determinations and requirements are not concise–the text can be interpreted in any of several ways. It is obvious that the ambiguity was purposeful, and I find that most troubling.

    In summary, what we have are a group of Congressmen and Senators who voted for a piece of legislation that they never read and a group of their supporters who call people names if they take said elected officials to task over it.

    So what you’re saying is that while pyrope has said nothing you disagree with (specifically the stuff about the bill being poorly written, the majority of Congressmen and women haven’t read it, and supporters -like yourself- will simply mock people who bring up the obvious flaws)… you laugh because a conservative insider says, “it will never be repealed?”

    That’s funny to you? A bad piece of legislation is okay by you, because it was done by Democrats? Is that what you’re saying?

    I’m now up to 600+ pages in the bill and it’s looking more like a sky scraper built by a shoe cobbler. (No disrespect to shoe cobblers, but it is what it is.)

    As for Dr. Krauthammer’s opining that -0bamacare shall never be repealed, there are two things to consider:

    1. Be careful what you wish for–you may well get it.

    2. Dr.Krauthammer’s remarks are predicated on the fact that -0bamacare is a tax, and it generally takes a cold day in hell before we see any tax bill repealed.
