U.S. Justice Department Files Lawsuit Against Arizona Immigration Law

Well, it’s happened. While there have been rumblings over the past few weeks that the U.S. Justice Department would be bringing a lawsuit to block the Illegal Immigration Law in Arizona, the suit hadn’t officially been filed until today. The stat of Arizona and Gov. Jan Brewer have been named as defendants.

From the Associated Press:

“The lawsuit filed in U.S. District Court in Phoenix argues that Arizona’s law requiring state and local police to question and possibly arrest illegal immigrants during the enforcement of other laws such as traffic violations usurps federal authority.
‘In our constitutional system, the federal government has pre-eminent authority to regulate immigration matters,’ the lawsuit says. ‘This authority derives from the United States Constitution and numerous acts of Congress. The nation’s immigration laws reflect a careful and considered balance of national law enforcement, foreign relations, and humanitarian interests.’
The government is seeking an injunction to delay the July 29 implementation of the law until the case is resolved. It ultimately wants the law declared invalid.”

With this (and the World Cup wrapping up), the immigration debate will return to the front of the news cycle. At least until something, hopefully, happens with that oil spill thing that’s still going on.

    This seems like a no-brainer for any sane court. States have the full authority to regulate what goes on within their borders as long as they are not contradicting federal law. In this case, the Arizona law is merely providing some local teeth to the existing federal immigration statutes. Only the most totalitarian interpretation of the US Constitution and a complete disregard for the spirit under which it was designed could come to the conclusion that Arizona has no right to manage a serious illegal immigration issue that the federal authorities have completely neglected.

    Where is Dan and what does he have to say about this? As the owner of this site, and as legal analyst for NBC, I would think he would weight in on this.

    Here comes trouble. I don’t know why they are doing this, well they know what’s up with the law. But I’d prefer it to be done outside the courtroom. Isn’t the state broke enough.

    BUT that does not change the fact that the President is a Shakedown Artists.

    He is a Community Organizer for crying out loud…that is what they do …. Shakedown companies.and it is legal…

    My fear is that the President and his gang will bankrupt BP, then take it over (and they own the Alaska Pipeline) like they did with the Auto Industry…that would not be a good thing…for you or me.

    Hope Mediaite is there to write about how the law is upheld..if the Feds refuse to perform their duties, the states have every right to protect their citizens.

    Agreed me1ranger; lamestreamers still ignoring the whole DOJ whistle blower case. Funny, if this had happened under a republican President, it would be headlined, screamed about, and reported every other minute. But, it’s teh one, so the story is spiked (in fairness, Steve Krakauer did at least write one article about it).

    I’m surprised that Dan has not weighed in on this lawsuit. Still waiting for the owner of this board, legal analyst to NBC, to provide some thoughts on it.

    And no discrimination even mentioned, just goes to show what an empty suit resides in the WH and how the media continues to be his number one enabler.

    Bank robbery is a federal crime. Maybe state and local police shouldn’t bother with that either. When 911 gets a call about a bank robbery in progress, they should just forward the call to the nearest FBI field office, and offer no back up or assistance. Additionally, if immigration enforcement was only a fed issue, why does the federal government offer training to local and state police agencies on how to enforce immigration laws.

    He’s so awesome, he can run the Executive Branch and take over for the judiciary! Give him a little practice and before you know it he’ll be doing all the legislating too.

    I so miss all that mewling about the Unitary Executive that the left seems to have forgotten was a bad thing.

    Tft…I saw your comment on this last night. I dunno if Dan Abrams wants to post “his legal opinion” on the matter here, on his own site, but it certainly would be interesting.

    Didn’t your mamma ever teach you about “Crying Wolf” That is exactly what you do when you toss out “Racist” for everything. You have numbed us with the term…as we are numb to most “…ist” and “…ism” words.

    What you fail to understand is that the Arizona law requires “PROBABLE CAUSE” to make a stop. The fed are a little more lenient…they can pretty much stop and search a car if it looks not right. BUT that is the feds…they do their thing, States do theirs.

    To make a traffic stop, Probable cause would be things such as speeding, not signiling, tail light out, break lint out, weaving down the road…things like that.

    Also another myth that you libs like to to use is that people are being stopped because they are a certain color. My advice for you…How do you tell what color someone is at night. The truth is…you can’t. But that doesn’t stop police from being called racist.

    We picked up a guy weaving down the road one evening, and he was drunk. While processing him at the station he began with the Racist chant. He had no DL in his possession, so we only had to go on what he gave us…He kept lying about his name, spelling, Address, SSN, etc all the things you need to know to clear someone.

    Now he made a major mistake…one of the names he used came back with a Felony warrant out of Florida. We were in a Western State. We told him that we had a hit and that he would be jailed and transported for Florida.
    You know what happened then…he remembered how to spell his name and his correct SSN.

    What he was really hiding was that he was married and in our town with his girlfriend in her car. His girlfriend left him and went home, and he had to call his wife and explain how he got down to our town and with who.
    Then we took him to jail.

    Do yourself a favor Jayson…ask your local law enforcement if you could go on a “ride-along!” You might learn something. (Don’t do it if you have a warrant for your arrest…if you do, you would get to see first hand how they process someone with a warrant for their arrest)

    I do realize it is so much easier to stand on the sidelines and hollar “Racist” to the moon!

    Glad the DOJ stepped in to take this clearly unconstitutional law to court and stop its implementation. Brewer passed this law as an election year ploy to gain attention and to look “tough”. Women have to be able to play ball with the men. Napolitano has demonstrated that she is taking actions to curb illegal immigration using technology, increase border patrols etc… and the numbers of illegal crossings are down substantially. The FBI has demonstrated that crime is down in all the border states. So, the people of AZ pay to advance “Movement Conservatism” that would take our nation back to the 1920′s when income inequality between the top 10% and the rest was exteme. She is using “racism”, bigotry and even distrust of the police to distract voters from the real issues of jobs, economic security and education to advance her personal political agenda . Way to go Jan!! You win a gold star for election year hi-jinks.

    So, let me see if I understand: The -0bama regime is ginning up a lawsuit against Arizona for doing what the Federal government SHOULD be doing in the first place–defending and securing our borders against invasion from foreign nationals. In other words, while doing so, the -0bama regime is usurping Arizona’s rights under the 10th (and probably the 14th) Amendment. Does that about cover it ladies & gents?
