Illinois Appellate Court Decides Rahm Emanuel Not Chicago Resident; Can’t Run For Mayor

The near term political career of former White House chief of staff Rahm Emanuel appears to have been dealt a rather significant blow with breaking news that an Illinois appellate court has decided against his legitimacy as a mayoral candidate for his hometown of Chicago, claiming that he is not, in fact a Chicago resident.

Huffington Post is reporting:

The Chicago News Cooperative is reporting that an Illinois Appellate Court has overturned a decision regarding Rahm Emanuel’s Chicago residency. The court reportedly decided Emanuel is not eligible to run for mayor of Chicago because he has not been a resident of the city for one year.

    Considering the past racial statements of Danny Davis and Carol Mosely Braun, I wondered if racial politics played a part, but that was clearly not a factor in the court’s decision.

    Wow, the ballerina gets smacked down by a mere 2-1 decision of an Appellate Court because of a law? What is going on in Chicago? Laws are for little people aren’t they?

    The actual opinion of the court makes an interesting read for folks like me who like to read this kind of stuff. The decision turned on a distinction found in the use of the words domicile, residency for voting purposes and residency for purposes of running for office. The court acknowledged that Emmanuel was qualified to vote in Illinois but then uses statutory construction to argue that he is not a resident for purposes of running for office. The distinctions are based upon statutory construction that are rather convoluted and tortured at best and seem somewhat arbitrary and to some extent contradictory on their face.

    “Having determined that the candidate satisfies the requirement
    to be an elector, we must still address the question of whether he has “resided in” the City of Chicago for at least one year next preceding the February 22, 2011, mayoral election; the second requirement for candidacy. 65 ILCS 5/3.1-10-5(a) (West 2008).

    As we have observed, the “reside in” requirement is stated separately from, and in addition to, the requirement that he be a qualified elector of Chicago in order to be a candidate for municipal office. The fact that the two requirements are stated separately and in the conjunctive leads to the inference that the legislature intended that they be considered separately from, and in addition to, each other.”

Recently he was appointed by the Obama administration to run the Office of Safe and Drug Free Schools in the US Department of Education.

    Man, born and raised in the town, been a part of it in some form or fashion ever since, rise to the White House Chief of Staff, come back to hometown and be told you cannot run as mayor because you didn’t live in the city for a concurrent year prior to the election (or whatever date was provided). Harsh. That rule sounds arbitrary too.

    Read the decision. I have no dog in this fight but the decision is bizarre. You are eligible to vote in the district for an office you cannot run for. Voting is a state issue so the federal courts have no jurisdiction. That’s unless activist judges usurp it unconstitutionally as in Bush V. Gore. Here is a link to the Rahm decision. Go on down to about midway through and start reading. You will see the convoluted argument the court makes.

    Sorry, the reasons were quite obvious. The State courts had to right to create law. If the Democrats wanted the Federal Courts to stay out, then they shouldn’t have tried to create law from the bench.
