Andrew McCabe Trashes ‘Ridiculous’ Complaint By Ted Cruz, Ron Johnson About ‘Unequal Justice’ for Alleged Capitol Rioters
The argument being made by five GOP Senators that alleged Capitol rioters are receiving “unequal justice” — when compared to those arrested during the social justice protests last summer — is not sitting well with one former top Justice Department official.
Appearing on CNN Tuesday, former FBI Deputy Director Andrew McCabe trashed the “unequal justice” claims made by five GOP senators in a letter to Attorney General Merrick Garland on Monday. In the letter, Sens. Ted Cruz (R-TX), Ron Johnson (R-WI), Mike Lee (R-UT), Rick Scott (R-FL) and Tommy Tuberville (R-AL) sounded off on what they deemed to be unjust treatment.
“DOJ’s apparent unwillingness to punish these individuals who allegedly committed crimes during the spring and summer 2020 protests stands in stark contrast to the harsher treatment of the individuals charged in connection with the January 6, 2021 breach of the U.S. Capitol Building in Washington, D.C.,” the senators wrote to Garland. They added, “Violence, property damage, and vandalism of any kind should not be tolerated and individuals that break the law should be prosecuted. However, the potential unequal administration of justice with respect to certain protestors is particularly concerning.”
Speaking with CNN anchors Poppy Harlow and Jim Sciutto Tuesday on Newsroom, McCabe blasted the senators for equating the Capitol insurrection to last summer’s demonstrations.
“It’s ridiculous,” McCabe said. “It’s another fig leaf that the Republicans are using to try to falsely equate the attack on January 6th with some of the violence that was a corollary to the social justice protests in the summer of 2020. The two are not the same.”
McCabe went on to express his belief that the DOJ has not applied the standard of law differently.
“The bottom line for the FBI and DOJ is if the cases are there, you bring them,” McCabe said. “Whether it’s emanating from a Black Lives Matter protest or a Trump rally that tries to take over the Capitol. If you have instances of violence, and you can prove cases against those folks that were engaged in it, you bring those cases. I think that’s what the FBI has done here — certainly with respect to January 6th.”
