Fox’s Andy McCarthy Calls Special Counsel Probe Into Obama a ‘Waste of Time,’ Says Ex-Prez Has Immunity
Fox News pundit Andy McCarthy called any special counsel investigation into President Barack Obama a “waste of time,” and reminded viewers that even if Obama was guilty, he’s subject to presidential immunity.
Speaking to Fox News anchor Bill Hemmer on America’s Newsroom Friday, McCarthy, a former assistant U.S. attorney, addressed a memo from Director of National Intelligence Tulsi Gabbard this week regarding Russian interference in the 2016 election.
McCarthy, who has already called the idea of a special counsel investigation “ridiculous,” said that any criminality on Obama’s part would be tossed based on the fact that President Donald Trump and former presidents are subject to “absolute immunity.”
A special counsel isn’t needed in the first place, McCarthy added, since there is no conflict of interest at play, leaving the door open for Attorney General Pam Bondi to appoint a special prosecutor.
“If they want to waste time and go through that again, they can do that,” McCarthy said. “They don’t need a special counsel for it. Bondi can just appoint someone to do it.”

BILL HEMMER: Andy, you believe the appointment of a special counsel would be ridiculous. How come?
ANDY MCCARTHY: Well, you know, look, we’ve already had a special counsel look at this for four years. But putting that aside, when he was under indictment by the Biden Justice Department special counsel, President Trump got the Florida indictment dismissed, arguing that the Justice Department special counsel regulations are unconstitutional and they resulted in unconstitutional appointments. So there’s that problem. There’s the problem that President Trump also took the position that presidents have to have, including former presidents, absolute immunity from prosecution. Obviously, that would apply to Obama, too. But you know, the most basic thing, Bill, is you only appoint a special counsel even assuming the regulations are constitutional, when there is a conflict of interest between the Justice Department and whoever is under investigation. You have that like in the Hunter Biden situation, where it’s the Biden Justice Department having to investigate the president’s son. There is no conflict of interest in the Trump Justice Department investigating Russiagate. If they want to waste time and go through that again, they can do that. They don’t need a special counsel for it. Bondi can just appoint someone to do it.

Earlier this week, Gabbard confirmed President Donald Trump’s White House is considering pursuing criminal charges against Obama during a White House press briefing.
On Thursday, McCarthy shot down the belief that Obama was guilty of “treason,” a word thrown around by the Trump administration in the wake of Gabbard’s report.
“They were throwing around the word treason in the last couple of days, which you know, is preposterous, because treason is making war on the United States or aiding our wartime enemies, which obviously didn’t happen here,” McCarthy said.
Obama has called the allegations “bizarre” and “a weak attempt at distraction.”
