Luigi Mangione’s New York Trial Delayed to Allow Defense to Present Double Jeopardy Arguments

Luigi Mangione’s New York state murder trial has been delayed to December 10 to allow time for preparation for his legal team’s double jeopardy defense.

Mangione pleaded guilty to federal stalking charges on Friday, August 14. His legal team filed a motion to dismiss his state charges of stalking per New York’s double jeopardy law.

Double jeopardy is a part of the Fifth Amendment that says a person cannot be tried for the same crime twice. It’s unclear how effective this argument will be, as the charges in each of the cases are different.

Justice Gregory Carro asked prosecutors to respond to Mangione’s legal motion by October 9. Mangione’s defense team will then have until October 30 to answer. Carro will ultimately decide if double jeopardy is at play.

Per CBS, “New York’s state law on double jeopardy is widely seen as being more generous to defendants.”

Mangione said Friday, ““Before traveling to New York, I used a 3D printer to make a gun. I traveled to New York with the intent to shoot Brian Thompson. On the morning of Dec. 4, 2024 I shot Mr. Thompson. I knew what I was doing.”

Mangione’s attorney Karen Friedman Agnifilo came under fire for a statement she made after the hearing.

“Mangione has been unfairly treated since the outset in every way and has successfully fought off terrorism charges and the death penalty while also fighting at the same time two simultaneous prosecutions in two jurisdictions, who are trying to punish him twice for the exact conduct. He’s been treated differently from every other defendant charged with this offense in New York,” Agnifilo said.
