California Gov. Gavin Newsom (D) celebrated a Tuesday court ruling that President Donald Trump’s federalization and deployment of the National Guard to Los Angeles earlier in the summer was illegal.
“DONALD TRUMP LOSES AGAIN,” Newsom posted on X following the court decision. Newsom continued his recent trend of posting to social media in a style and tone that mocks Trump’s social media presence.
Newsom added, “The courts agree — his militarization of our streets and use of the military against US citizens is ILLEGAL.”
US District Judge Charles Breyer pulled no punches in his 52-page ruling, which concluded the Trump administration breached the Posse Comitatus Act. The 1878 law bans the U.S. military from operating as a domestic police force. Breyer’s ruling came in connection with Newsom lawsuit against the Trump administration for deploying troops to LA without his consent to quell riots in the city over ICE raids — riots LA officials have claimed were already dealt with by local law enforcement.
“President Trump and Secretary Hegseth have stated their intention to call National Guard troops into service in other cities across the country,” Breyer noted, warning that Trump is using the military as “a national police force with the President as its chief.”
Breyer added that the “Defendants systematically used armed soldiers (whose identity was often obscured by protective armor) and military vehicles to set up protective perimeters and traffic blockades, engage in crowd control, and otherwise demonstrate a military presence in and around Los Angeles. In short, Defendants violated the Posse Comitatus Act.”
The court, therefore, issued an injunction barring Trump from deploying troops to more U.S. cities, as he’s threatened to do, pending an appeal.
