House Republican Pushes Bill to Limit ‘Rogue Judges’ Trying to Free Migrant Imprisoned In El Salvador By ‘Error’
Fox News anchor Harris Faulkner spoke with Rep. Chip Roy (R-TX) on Tuesday about Monday night’s Supreme Court decision to temporarily block a lower court’s order to return a migrant who Trump’s DOJ admitted was deported and indefinitely imprisoned in El Salvador by “error.” During the conversation, Roy promoted his bill to limit the power of district judges, whom he called “rogue” and “activists” for ruling against Trump.
“The U.S. Supreme Court has handed the Trump administration a major victory. It ruled Trump is allowed to use a wartime authority to deport alleged Venezuelan gang members. Now, all of this is after Washington, D.C., Circuit District Judge James Boasberg tried to block the president,” Harris began, adding:
The court also ruled the appropriate venue for these kinds of proceedings would be in Texas or wherever the plaintiffs are being held. As a result, then, Judge Boasberg had to cancel his D.C.-planned hearing on the case today.
And the president posted the U.S. Supreme Court has upheld the rule of law in our nation by allowing a president, whoever that be, to be able to secure our borders and protect our families and our country itself. A great day for justice in America. Trump administration is also taking a victory lap.
After playing a clip of Trump officials lauding the court decision, Harris introduced Roy and said, “First of all, I just want to get your reaction to a couple of victories, really, for the administration.”
“Well, first of all, this important ruling from the Supreme Court reset the table with respect to the activism, the blatant activism by Boasberg. Now let’s keep in mind what the court said. The court said that, look, he had no business doing this from the District of Columbia. This is a flight that was originating in Texas to remove people that are being rightfully removed because they’re a danger to our country,” Roy said, adding:
Now pause for a second. How do I know that they’re danger to country, Harris? 47 people affiliated with Tren de Aragua were just caught literally in Dripping Springs, Texas, not far from where I live. This is a real issue throughout Texas because of the absolute devastation that the Biden administration wreaked upon the United States and its people. So now President Trump is doing the right thing to remove these dangerous gang members and this activist judge inserted himself.
Notably, the Trump administration has been accused of deporting and indefinitely imprisoning multiple migrants who are not affiliated with the violent gang. A 60 Minutes investigation revealed on Sunday that 75% of those deported and imprisoned in El Salvador in fact did not have criminal records in the U.S. or around the world that they could find.
Roy then went on to warn against on of Trump’s Supreme Court appointments:
Now the good news is the Supreme Court said, no, you don’t get to do that. This should have been in Texas, and there’s a process for doing this, and that the law is good law. My concern is, is that Amy Coney Barrett didn’t follow the majority, so there was one that voted the wrong way.
My other concern is that they said there needs to be a reasonable time for these folks to be able to go appeal their case, which means it’s going to go back to habeas cases, which means there’s going be a churn on these cases. So it’s good news, but it’s not something that we should take to the bank without changing. That’s why, as the chairman of the Constitution subcommittee, we had a hearing about legislation that we need to move through the House to limit some of the abuses that are taking place with these nationwide injunctions by these rogue judges.
“Congressman, you and I have had this conversation before about the first law breaking was coming across the border illegally, and then other acts potentially, and maybe even the previous, you know, gangster membership for some of these people. My question is, if you’re going to get habeas corpus, if your going to have the ability to appeal, what exactly are you appealing? Because you came here illegally, you’ve already broken the law,” added Faulkner.
“Well, that is my view, and I think we should take that view as a country. I want to be very clear. The president of the United States is completely correct, and he’s following his role as commander in chief to defend the United States of America to then act and remove these dangerous actors. Remember, Jocelyn Nungaray died last summer at the hands of Tren de Aragua,” Roy continued, adding:
Cindy Romero was testifying in my committee of all the dangers that she was exposed to in the apartment complexes in Aurora, Colorado. This is real. And as I said, in my backyard, literally in Dripping Springs, Texas, just last week, 47 people, including nine children, by the way, in what we believe was a stash house.
This is real and the president deserves great latitude to remove these individuals. What will happen is leftist groups, frankly often funded because Congress is stupid and funds money to these, you know, NGOs, and they use that to then fund this litigation, they will take these cases to court and they’ll say, oh, no, no. They were rightfully released into the United States and they deserve their day court to prove that, in fact, the paroles and the asylum cases that the Biden administration abused to release these dangerous criminals on our streets is something that should prevent them from being removed. But the president is correct to remove these dangerous folks under his powers as commander-in-chief.
