There were plenty of arguments about it being illegal back in 2007 when Obama said, during the Democratic primary campaign, that he would do this very thing. From the Washington Post in summer 2007: “The way to deal with it is not to announce it, but to do it,” Sen. Joeph Biden said yesterday at the National Press Club. “The last thing you want to do is telegraph to the folks in Pakistan that we are about to violate their sovereignty.” Biden is basically acknowledging that it is illegal and we should do it anyway, just don’t announce beforehand that we will. I can’t answer that from military experience because I wasn’t at the stage of my life where I paid much attention to such things, and we cold warriors didn’t have to sweat what the CinC was up to to the extent that troops do now. We didn’t talk politics a lot because we weren’t at war. But if I had to guess, I’d say that our all volunteer force, much of which joined under Bush while we were at war would tend to be seen as supportive of it. You are right and he’s right. The Bush administration authored torture memos to go around the law. That’s the only reason Yoo drafted those memos the way he did. It was to give them legal cover. So, effectively, what they did was legal but it doesn’t change the illegal nature of waterboarding now. It’s insane to claim that unless organ failure is imminent, torture is not being done. Bush days(not too long ago actually), the left used to decry the actions of US military in Iraq and Afghanistan, who used common sense to take out potentially dangerous combatants the left referred to as “unarmed innocent civilians”, who mastered the tactics of creating and planting road side IED’s that killed hundreds and thousands of US military men, while those combatants pretended to be average villagers. US soldiers have actually faced trials for such actions with pressure from the left.

The Geneva convention and even the US military code of conduct explicitly states that unarmed men should be taking captives and not shot, yet Osama Bin Laden who was not armed when the SEALs found him did get shot to death in the head. We all know the Navy Seals did the right thing by wiping him out from the earth and avoiding a show trial, but the point here is that it would not be a rosey affair with the liberal mainstream media and those on the left, assuming it was a Republican president who authorized the violation of a Muslim nation’s sovereignty, and the shooting of an unarmed combatant.

This operation was 100% legal; remember Obama is the President.
