GOP Congressman Calls For Trump To Ignore Court Orders: ‘Take A Page Out Of Andrew Jackson’s Playbook’
Representative Chip Roy (R-TX) called on President Donald Trump to “take a page out of [former President] Andrew Jackson’s playbook” and ignore federal court orders that seek to block his actions.
The comment comes as legal commentators are increasingly warning the current standoff between the executive branch and the judiciary could become a “constitutional crisis” after a federal judge in Rhode Island ruled this week that Trump is defying an order to release frozen federal grant money. The administration responded by filing an appeal and launched blistering attacks on the judiciary.
Over the weekend, Vice President JD Vance poured gasoline on the fire, posting on X: “Judges aren’t allowed to control the executive’s legitimate power.”
Historically, Presidents have flirted with defying the courts. Former President Abraham Lincoln issued passports to Black Americans despite the Dred Scott ruling and refused to abide by Supreme Court Justice Roger Taney’s call to release a prisoner.
Jackson had a similar response to the Supreme Court’s ruling in Worcester v. Georgia (1832), after the Court had declared that Georgia’s actions to dispossess the Cherokee Nation of their land violated their sovereignty. While the ruling was directed at the state, not Jackson, he refused to enforce the decision, effectively allowing Georgia to continue its actions in a forced removal of the Cherokee people along the Trail of Tears.
With close watch on how the Trump administration will respond to court orders pushing back on the flurry of executive orders the president has implemented since the beginning of his second term, just weeks ago, Roy appeared on Fox News to speak with host Laura Ingraham.
When asked about how Trump will navigate the injunctions, Roy replied:
Keep in mind the president beat lawfare going after him when he was a candidate. The president is going to beat this in my opinion. Yes, I think he should take a page out of Andrew Jackson’s playbook.
At some point JD Vance is right when he said hold on you can’t have a judge step in when the president is exercising his constitutional authority.
Imagine if a judge said: ‘Mr. President, as commander-in-chief, you can’t bomb this particular city or this certain area.’ You can’t do that, you have to give the president to be the chief executive. I hope they will continue to let him do that.
Congress needs to make executive orders permanent. We need to pass laws to back up laws to pass his agenda and we need to move quickly to do that and we can stand behind the president. The president is right to say follow the law, but the constitution matters too. He can do his job.
