Tracy Morgan’s Lawyer to Today: He’s ‘Still Struggling’ 2 Months After Crash

Tracy Morgan appeared to be in good spirits last month when cameras caught him smiling and thanking fans following the June highway accident that left him in critical condition and killed his friend and fellow comic James McNair. But according to his lawyer, Benedict P. Morelli, Morgan is “still struggling” two months later.
Morelli spoke to the Today show’s Matt Lauer about Morgan’s condition and the lawsuit he is bringing against the Wal-Mart corporation, whose truck driver, Kevin Roper, slammed into Morgan’s tour van allegedly going 20 miles per hour over the speed limit.

“He’s still struggling,” Morelli said. “But he’s a fighter. He’s had issues before that he’s fought through, and he’s fighting hard.” He noted that early rumors said Morgan was either dead or had lost a leg and now people think he’s doing great. “None of those things are true or accurate,” he said.
Asked by Lauer why he thinks the incident was “something more than a tragic accident,” Morelli outlined how Roper has been up for “approximately 25 hours” when the accident happened. He said he plans to show in court that these long hours are part of the “culture” at Wal-Mart. “That’s what they set up,” he said. “They have to make sure that this doesn’t happen.”
