Gavin Newsom Says Trump ‘Will Be Relieved Of His Command’ of National Guard By ‘Noon Tomorrow’
California Gov. Gavin Newsom announced on Thursday that President Donald Trump would “be relieved of his command” of the National Guard in California by “noon tomorrow” after a judge ruled Trump’s deployment of the Guard was illegal.
“The notion that the United States active-duty Marines, these heroes would be used to militarize the streets of an American city, is an abomination,” Newsom told reporters during a press conference, adding:
The founding fathers did not live and die to see that happen in this country for no reason whatsoever than vanity, theater, to instill fear, to incite a response, so I’m very hopeful this order puts that in perspective and hopefully Donald Trump will immediately back down. The courts have ruled on the Guard. They will be back under my command and he’ll be relieved, Donald Trump will be relieved of his command at noon tomorrow.
Asked whether it was likely President Trump would even honor the order, Newsom replied, “Donald Trump better abide by these orders or we have a constitutional crisis the likes of which we haven’t seen in our lifetime.”
Not long after Newsom’s press conference, the Ninth Circuit Court of Appeals granted the Trump administration an administrative stay of the ruling, keeping the National Guard in Trump’s command as a three-judge panel considers the case.
Prior to the administrative stay, U.S. District Judge Charles Breyer ruled on Thursday that the ongoing unrest in Los Angeles fell “far short of ‘rebellion,'” and that Trump’s deployment was therefore illegal.
“While Defendants have pointed to several instances of violence, they have not identified a violent, armed, organized, open and avowed uprising against the government as a whole,” wrote Breyer. “The definition of rebellion is unmet.”
Trump administration official Jeffrey Clark called Judge Breyer’s ruling “a blunt insult to presidential power” and “a mockery of our Constitution,” arguing, “If it stands, the Commander in Chief of all of the Nation’s forces is forcibly reduced to a commander in junior — junior to both Governor Newsom and junior to Judge Breyer.”
