Nevada Judge Dismisses Case Against Fake Trump Electors

A Nevada district court judge threw out a case against six GOP electors who submitted certificates falsely declaring Donald Trump the winner of the 2020 presidential election.

According to the Washington Post, Clark County Judge Mary Kay Holthus stated that prosecutors chose the wrong jurisdiction to file charges against the defendants. Therefore, as long as the statute of limitations has not passed, the state can bring charges in another jurisdiction moving forward. So-called fake electors have also been charged in other states like Michigan, Georgia, and Arizona.

However, per WaPo, after the case was filed in Clark County the statue of limitations for the crimes ran out, meaning it would by impossible for the case to be refiled in another jurisdiction.

Following the 2020 election, supporters of the former president across several states submitted false ballots declaring him the winner of the election by sending signed documents to Congress. Prosecutors in Nevada charged the electors with felonies related to fraud.

If convicted, the defendants would have faced a maximum prison sentence of four or five years in prison. One of the indicted electors included Nevada GOP chairman Michael McDonald.

The office for Nevada Attorney General Aaron Ford, who led the prosecution against the electors, released a statement claiming they plan to “immediately” appeal the decision made by Holthus.

Republican electors in Pennsylvania and New Mexico were not charged by local or state prosecutors for the fake electors scheme.
