Trump Falsely Claims Biden Was ‘Convicted’ in Documents Case
Former President Donald Trump erroneously claimed to Fox News on Monday that President Joe Biden was convicted for retaining classified documents as a private citizen.
Trump was indicted last year after an August 2022 FBI search at Mar-a-Lago turned up a trove of government material. The Department of Justice alleges Trump, who pleaded not guilty, willfully retained classified documents and obstructed the government’s efforts to retrieve them. The case was upended earlier this month when a federal judge he appointed controversially tossed the case. The DOJ is appealing.
Biden was caught up in his own documents drama. Representatives for Biden reported that the president possessed classified documents from his time as a senator and vice president, and Biden’s lawyer voluntarily turned the material over to the federal government.
The special counsel probing Biden’s documents retention ultimately declined to bring charges, stating that a jury would likely view him as an “elderly man with a poor memory” and thus, might be unlikely to convict.
In an interview on Fox News, Laura Ingraham asked Trump, “Why do people not trust the upper echelon of the FBI at this point?”
“Well, they’ve had a bad period of time,” he replied. “I mean, they raided Mar-a-Lago. That’s not so good. And I guess, we bring a suit. You know, we won that whole case. We won it the right way. We won it because won it. We won it in court. It was a big thing. Hardly got any publicity.”
Trump then reiterated his false claim that he was legally entitled to keep the documents.
“I was allowed,” he continued. “The Presidential Records Act.”
Last year, the National Archives issued a rare statement, saying the documents found at Mar-a-Lago were supposed to be given to the agency upon Trump’s departure from office.
“Now, with Biden, he really was convicted of that case,” Trump added, despite the fact Biden was never even indicted. The former president then went on to falsely claim that the special counsel did not bring charges because Biden was ruled too “incompetent” to stand trial. In reality, the special counsel simply declined to pursue the case.
He was let go of that case,” he added. “They said he was incompetent and therefore, he can’t stand trial. And yet, he would’ve been allowed to be president. Think of that. So, he sort of semi-won it. Course, you don’t wanna have that kind of a victory. You win because you’re incompetent. But he actually was guilty.”
