Mukasey: Red State Lawsuits over Obama’s Immigration Action Would Go Nowhere
Former Attorney General Michael Mukasey told Fox News’ Gretchen Carlson Thursday afternoon that the idea floated by a couple of red state governors of suing President Barack Obama over his proposed executive action on immigration would likely go nowhere.
Texas Governor Rick Perry and Wisconsin Governor Scott Walker have both mused aloud about the idea of legally challenging the federal government over proposed legal protections for undocumented immigrants currently residing in the U.S.
“Anybody can sue anybody,” Mukasey said. “The question is can it succeed? I don’t think any lawsuit to stop what the president seems inclined to propose would be successful. There is something called the political question doctrine, that basically courts apply when they want to stay out of a controversy between the other two branches of government, and they would apply it here.”
