JUST IN: Supreme Court Rules Trump Can Fire Biden Appointee From the FTC

 

The Supreme Court presented President Donald Trump a major victory on Monday, ruling he can fire FTC Commissioner Rebecca Slaughter after months of battling in court.

The president has been pushing to fire Slaughter, a Democrat who was appointed by former President Joe Biden, since March. Monday’s ruling comes as the court said it will weigh whether the president can fire members of the Federal Trade Commission without cause.

While that case is being litigated, NBC News reported Slaughter will not be able to remain in office.

The 6-3 ruling on Monday comes just a few weeks after Justice John Roberts ruled in the president’s favor and blocked Slaughter’s reinstatement.  She was one of two Democratic commissioners that Trump fired in March — the other being Alvaro Bedoya; both legally challenged the move initially, before Bedoya later dropped his case. Slaughter’s 7-year term was not set to expire until 2029 and was the last Democrat-nominated commissioner.

Slaughter had a federal judge rule in her favor in July, with the judge citing the 1935 case Humphrey’s Executor v. United States, where the Supreme Court ruled there are some restrictions on the president’s oversight of the FTC.

Trump’s Justice Department has argued the president is allowed to fire commissioners as he sees fit.

“The president and the government suffer irreparable harm when courts transfer even some of that executive power to officers beyond the President’s control,” Solicitor General D. John Sauer argued.

The Supreme Court, by a 6-3 margin, agreed. Monday’s ruling, according to the Associated Press, signaled “the conservative majority is poised to overturn or narrow a 1935 Supreme Court decision that found commissioners can only be removed for misconduct or neglect of duty.”

Their decision will come sooner than later, with the Supreme Court expected to hear arguments on Humphrey’s in December.
