CNN’s Toobin: If Dems Retake Senate and Give Trump Another SCOTUS Seat, They Might as Well ‘Give Up’

On CNN earlier tonight, Jeffrey Toobin said it would be pretty “pathetic” if Democrats retake the Senate only to then approve another President Trump Supreme Court nominee.
The Supreme Court is back in the news today for upholding the Trump administration’s travel ban. Some of the media coverage has noted how this represents a victory for Mitch McConnell over holding up Merrick Garland‘s nomination only to then end up with Neil Gorsuch.

A CNN panel tonight discussed the news and the chances President Trump gets to pick another nominee, particularly if the Democrats win the Senate in November.
And if they do, Toobin said, it would be baffling for them to just accept whoever he nominates:
“If the Democrats retake the Senate, and they confirm a Donald Trump nominee to the Supreme Court, they ought to just close down the Democratic Party and give up. It would be the most pathetic admission of weakness in defeat.”
He personally has doubts about Democrats taking back the Senate, but said if they do, “giving another seat” to Trump after McConnell “stole one” would be “simply inconceivable.”
