Trump Classified Docs Case Dismissed in Florida By Judge Cannon
Judge Aileen Cannon has dismissed Donald Trump’s classified documents case in Florida.
A 93-page court order released Monday granted Trump’s motion to dismiss the case “based on the unlawful appointment and funding of Special Counsel Jack Smith.” The order states that Smith’s appointment as special counsel overseeing the case violates the Appointments Clause in the Constitution.

The former president was facing more than 40 charges over his handling of classified documents after leaving the White House. The FBI raided his Mar-a-Lago property in 2022 to retrieve documents previously requested by the Department of Justice.
Cannon argued that Smith’s appointment violates the Constitution because he was not appointed by the president or confirmed in the Senate for the role. The decision is likely to face appeal as other recent special counsel appointments like Robert Mueller have also not met such requirements.
