Asked by conservative radio host Hugh Hewitt about the county clerk who has continually refused to issue marriage licenses to same-sex couples in Morehead, Kentucky, Sen. Lindsey Graham (R-SC) offered up a surprisingly straightforward prescription on Tuesday: “As a public official, comply with the law or resign.”

“The rule of law is the rule of law,” he added. “We are a rule of law nation.” While he said he “appreciates her conviction” and himself “supports traditional marriage,” Graham said the clerk, Kim Davis, “has accepted a job where she has to apply the law to everyone.”

The Supreme Court denied Davis’ request for an injunction on Monday, ruling out the possibility that people in her situation could receive an exemption from the law based on religious objections to same-sex marriage.

Davis and her staff have now been summoned by a federal judge and could face fines and/or jail time. Asked by reporters on whose authority she had yet again denied the licenses, Davis replied, “Under God’s authority.”
