Stephen Miller Defiant When Asked to Clarify His ‘Legal Insurrection’ Attack on Judge

 

White House Deputy Chief of Staff Stephen Miller took questions from the press on Monday outside the White House and was asked to clarify his recent attack on a Trump-appointed judge.

“You called a legal ruling, legal insurrection. Are you recommending the president take action against judges with rulings you disagree with?” a reporter asked Miller.

“No, it’s simply a factually accurate statement that when a judge assumes for him or herself the powers that have been delegated by the Constitution to the president, that that is a form of illegal insurrection. And we have seen—” a defiant Miller replied.

The report cut in to note, “The ruling carries legal weight. So are you recommending—”

“No, we have seen, over the last nine months, an ongoing legal insurrection in which district court judges, as a class in many cases, have issued—which is why they’ve been overturned so much—have issued rulings that are flagrantly unlawful and unconstitutional,” Miller replied, adding:

And it is an insurrection against the laws and Constitution of the United States. And we need to have district courts in this country that see themselves as being under the laws and Constitution and not being able to take for themselves powers that are reserved solely for the president.

Over the weekend, Miller attacked U.S. District Court Judge Karin Immergut, who ruled against Trump’s order sending troops into the Oregon city on Saturday in a scathing decision.

“This is a nation of Constitutional law, not martial law,” Judge Immergut concluded, adding that Trump’s orders “risk blurring the line between civil and military federal power — to the detriment of this nation.” Miller was widely condemned for his attack on the judge and suggestion that the courts have no authority over Trump’s powers.
