The legal team for author E. Jean Carroll expressed “serious concerns” that former President Donald Trump does not have the cash to pay their client the $83.3 million judgment she was awarded last month.
In a court filing on Thursday, Roberta Kaplan, Carroll’s lawyer, responded to Trump’s latest demand the trial judge delay enforcing the judgment while his legal team attempts to reduce or eliminate it on appeal.
A New York jury awarded Carroll the eight-figure sum for defamation last month. Previously, another New York jury found Trump liable for sexually abusing Carroll in a department store back in the 1990s and awarded her $5 million.
“He simply asks the Court to ‘trust me’ and offers, in a case with an $83.3 million judgment against him, the court filing equivalent of a paper napkin; signed by the least trustworthy of borrowers,” Kaplan wrote in the court filing.
Kaplan referenced Trump’s $454 million civil fraud verdict as reasoning behind their concern Trump may not have enough cash on hand to fulfill their judgement.
“To begin, recent developments give rise to very serious concerns about Trump’s cash position and the feasibility (and ease) of collecting on the judgment in this case,” she added.
Trump attempted to post a $100 million bond in his fraud case yesterday while the process goes through appeal, but a New York judge ruled he must post a complete bond. Each day Trump does not make the payment it grows with interest.
“Moreover, by the time the post-trial motions (or the appeal) are fully resolved, Trump may be in a very different position,” Kaplan noted.
“He could then be President of the United States; he could then be a convicted criminal serving time behind bars; or, given his advanced age, Carroll may be forced to reckon with his estate. Any of these developments could substantially complicate collection efforts here,” she concludes.
