MSNBC Panel Rips ‘Slow-Moving’ Merrick Garland for Lack of Big Name 1/6 Prosecutions: ‘Biden Could’ve Nominated Liz Cheney’

 

Elie Mystal of The Nation said Joe Biden’s decision to tap Merrick Garland for attorney general is why there haven’t been any prosecutions of high profile figures in connection with the storming of the Capitol, as well as the effort to overturn the 2020 presidential election.

On Thursday, the House select committee investigating the January 6th Capitol riot subpoenaed Phil Waldron, a retired Army colonel who circulated a PowerPoint among allies of Donald Trump before the attack. The 38-page presentation outlined an extreme plan to overturn the election results and eventually made its way to Trump chief-of-staff Mark Meadows. Meadows has also been subpoenaed by the committee but is refusing to appear before it.

MSNBC’s Jason Johnson asked Mystal about the pace of the investigation. “Are there ways we could be moving faster?”

“Sure, we could be moving faster,” Mystal replied, who became increasingly animated during his response. “Joe Biden could’ve nominated Liz Cheney for attorney general. Maybe that would’ve worked out. Or maybe he could’ve nominated Jamie Raskin. Or Adam Schiff! Or Joyce [Vance]! or Glenn Kirschner! Or you! Or me! Or a ton of other people who would be putting the wood to these people by now already!”

Mystal acknowledged the probe is ongoing but added,

My question is why is the Congress doing the investigating and not the FBI. Where’s Chris Wray? Where’s Federal Society, Republican-appointed Chris Wray on these subpoenas? Why is Brad Parscale turning over documents to the select committee as opposed to the FBI? Why is Waldron being subpoenaed by the select committee as opposed to the FBI? Is the FBI on the case? Now, they might argue that they are and maybe we don’t know and there’s a super-double-secret investigation that’s boiling beneath the surface that’s ready to erupt. Maybe that’s the case, but I don’t see evidence of that.

Mystal concluded by blaming the seeming lack of action by the DOJ on Garland.

“I think it all comes back to Joe Biden’s decision to appoint Merrick Garland – a slow-moving institutionalist – to the Department of Justice.”

Johnson agreed, saying, “Harvey Dent would’ve been able to do a better job so far than what we’ve seen from Merrick Garland,” referring to the Batman character, Two-Face.
