Convicted Florida Scammer Won’t Go to Prison Because He’s Too Obese

Most “Florida man” stories involve someone who is headed to prison for something. This is one of them. The only catch? This particular Florida man says he can’t go to prison because he’s morbidly obese. Yes, you’ve heard of “too big to fail,” now meet “too fat to jail.”

James Olivos pled guilty last December to running a real estate scam and the judge ordered he be sentenced to five years in prison and pay back the almost three million dollars he ripped off from other people.

Except Olivos has missed three dates now for the start of his prison term. His excuse: he’s a morbidly obese man and his obesity can’t be sufficiently treated in prison. WESH 2 reporter Bob Keating confronted Olivos about this excuse, and when asked if he still believes he’s too fat for prison, he said, “Yes, I am sir. Thank you very much.”

Magistrate Karla Spaulding got teed off last week when he threw out the medical excuses and accused him of stalling.
