Dan Abrams Analyzes Appeal In Amanda Knox Case On Today

NBC’s Chief Legal Analyst and Mediaite founder Dan Abrams sat down with Today‘s Lester Holt to discuss the continuing case of Amanda Knox, the American student who was found guilty of killing her roommate in Italy this winter. The appeals, Abrams argues, will probably not result in any increased sentence, but there is a higher likelihood the sentence will be reduced.

Abrams also explained how the Italian appeal system works– unlike in America, where an appeal must strictly analyze the goings-on during the trial, the Italian court can revisit evidence surrounding the crime for which the appellant was convicted, which could significantly change the results of the trial.

    Why didn’t Dan Abrams go ahead and say the prosecutor, Mignini, was convicted of abuse of power and abetting. Mignini was sentenced to 16 months in prison but he is on probation and allowed to continue in his position. This officially makes Mignini a criminal. Now the situation is this criminal is asking for Amanda’s prison sentence to be increased to life in prison. Give me a break.
    I have reviewed all the evidence available to us and I’m convinced Amanda was deliberately framed. As intended a lot of hard work is required to understand what happened, but what happened is very simple. Guede was desperate for money because the cops caught him with items he stole from a law office, and they told him to get out of town!!! Guede watched the girl’s secluded apartment several days, then one evening he busted the window, and climbed in a few minutes before Meredith unexpectedly came home. He was plundering Filomena’s room, which is close to the entrance door, when he heard Meredith come in. He got quiet, and she walked to her room not knowing he was there. She called her mom at 8:56 pm and seconds later he surprise attacked her, interrupting the call before her mom could answer. Guede ended the call and soon he ended her life. He acted alone out of greed and desperation.
    This is clearly and exactly what all the evidence points to. Mignini twisted the evidence to convict Amanda. He didn’t care about Raffaele, he wanted Amanda. They never looked for truth, the investigation was tailored to convict Amanda. How stupid does he think we are?

    GUEDE BURGLARY HISTORY/RECORD Cristian Tramantano

    What has emerged, and what particularly interests the defence, is that Guede had come into contact with the police at least three times in the weeks leading up to Meredith’s murder.

    On September 27, 2007 – five weeks before the killing – Perugia bar tender Cristian Tramantano heard a noise downstairs in his home and found Guede wandering around with a large knife. Tramantano recognised Guede from his work in a nightclub.

    There was a confrontation between the two, which ended when Guede ran away. On four occasions, Tramantano went to Perugia’s central police station to report the break-in, identify Guede as the culprit and to detail how the intruder was armed and threatened him.

    On each occasion, he says he was ignored and the police refused to log his complaint.

    FROM THE JUDGE MICHRLI’S REPORT:
    On 7 January 2008, meanwhile, appeared at the Flying Squad in Perugia T. C.[Cristian Tramantano] and A. M. [Monika] The first reported to have suffered a burglary at his home on 1 or 2 the previous September, by a colored boy who – following the publication in the press of numerous photos of G.[Rudy Guede] – Believed to recognize in today accused. In particular, the man reported that at six o’clock on the day mentioned was awakened by some noises coming from the room below the environment of the bedroom, ready to loft, facing, like her partner who was in his company He had seen a young man of color, intent on rummaging through his stuff, so it was dropped in a hurry out of bed to try to send him away. The other, at that point, had begun to descend the spiral staircase that communicated with the floor below, but – he found the door closed – it was pointed at the T.[Tramantano]who had followed him, before grabbing a chair to wield against him, then pulling out a knife: the complainant, frightened, went back upstairs, while his girlfriend [Monika]called the “113″, during which time the thief – who said a few words in perfect Italian, and had vinous breath – unable to escape.
    Verify the extent of what had been stolen, the man noticed the lack of a few cash and three credit cards, the very next evening, going to the disco “Domus”, it had seemed to review the boy in question between the customers of the restaurant. A distance of time, seeing the photos of G.[Rudy Guede] newspapers, T.[Tramantano] had the impression that it was indeed the author of the theft.

    Still, the fact that T. C.[ Cristian Tramantano] have meant to recognize in G.[Rudy Guede] the young man of color that surprises during the home burglary, leave things as they are, while not wishing to consider the fact – deduced from the defense, and that may be considered eligible even if not documented – which has been in turn a test “mediated “from television: the survey is in fact expressed in terms skeptical, with a repeated” it seems “, or even already reported at the time T.[ Tramantano] would see R.[Rudy Guede] the “Domus” in the evening after the theft, and even less justifiable when he had time and method to see the photograph on all organs of the press and broadcasters.

    The following weekend, there was a break-in at an English-speaking nursery school in Milan in which 2,000 euros and a digital camera were stolen. The school owner, Maria Antoinette Salvadori del Prato, reported it to her local police station.
    Three weeks later, on Saturday, October 27 – one week before the murder – Mrs Prato arrived at the school early in the morning with a locksmith to replace the front door, only to be confronted by Guede standing in the main entrance.
    Police were called and Guede questioned. A stolen laptop, digital camera and ten-inch kitchen knife were found in his backpack.
    But instead of being arrested and charged, Guede was merely escorted to Milan central railway station and placed on a train back to Perugia.

    From the judge’s report: “while October 27, 2007 (ergo, just five days before the murder), he was identified in that of Milan and reported on the loose for theft, receiving, possession and carry firearms

    In the interim, on the weekend of October 13, there had been a break-in at the office of lawyers Paolo Brocchi and Luigi Palazzoli, in which a firstfloor window was smashed – similar to the break-in at Meredith’s house. A computer and other items were stolen.

    They were later found in Guede’s possession, but he was not arrested or charged.

    This series of crimes and the absence of police action has led Knox’s defence team to believe Guede may have been an informant being protected by someone in the police force.

    If that is the case, then it must be investigated, as that failure to act left Guede free to murder Meredith.
