Jack Smith Appeals Directly to the Supreme Court to Resolve Whether Trump Has Immunity

Special counsel Jack Smith has appealed directly to the U.S. Supreme Court to resolve once and for all whether former President Donald Trump is immune from criminal prosecution.
CNN noted that this is “the first time that the high court will weigh in on the historic prosecution of the former president.”
Legal analysts believe Smith made the “extraordinary request” so he could skip a federal appeals court decision that could delay the election subversion case set for early March.
If the Supreme Court accepts Smith’s request, they would review district Judge Tanya Chutkan’s ruling that Trump is not immune from prosecution for alleged crimes committed while in office. Trump has claimed presidential immunity for his role in the 2020 election subversion case.
