R.I.P. Bloomberg’s Soda Ban: NY Court Ruling Signals Law’s Final Defeat
While the high court was striking down recess appointments and abortion clinic buffer zones, a lower court was delivering another blow: the New York State Court of Appeals officially ended former New York City Mayor Michael Bloomberg’s ban on large sugary drinks.
Ruling that the city had “exceeded the scope of its regulatory authority,” the court voted 4-2 to uphold lower court decisions overturning the ban.
The law had pitted public health activists, who believe the offerings participate in obesity levels, against the soda industry and civil libertarians who lamented the “nanny state.”
