Nephew of Clarence Thomas Allegedly Punched And Tased By Hospital Security

This is an unpleasant story. News broke yesterday that Derek Thomas, the nephew of Supreme Court Justice Clarence Thomas, had allegedly been beaten and tased by hospital security after being admitted and refusing to don a hospital gown. Thomas, who is an epileptic, reportedly suffered a massive seizure as a result of the incident. From AOL:

Derek Thomas, 25, was admitted to West Jefferson Hospital on Thursday after what some news outlets described as a possible suicide attempt. When orderlies asked Thomas to put on a hospital gown, he refused and tried to flee the facility. That’s when security guards stepped in, and a scuffle ensued. Details were reported by several news agencies.

One of the guards punched Thomas, pulled out his hair and them shocked him with a Taser, the patient’s sister, Kimberly Thomas, wrote in an e-mail to ABC News. Because of the fight, Thomas suffered a serious seizure, she said.

Local TV station WDSU reports that Justice Thomas, himself, is on his way down to New Orleans to investigate. Watch ABC’s report below.

    Well, we’ve heard one side of the story … it will now be interesting to what if anything the hospital has to say within the confines of patient privacy rights.

    Was the nephew unruly, combative and/or threatening … and if so, to what extent? We just don’t know at this point.

    Michael T, you fucking idiot. The man has epilepsy. People with this affliction are quite often not rational when their medications get out of balance. Medications for epilepsy can and often do react with one’s insulin levels.

    What’s funny about this is that Thomas would have been OK with this happening to someone else’s child. Read some of the insane opinions he has written on crime and punishment issues. For the record, what was done to his nephew was wrong and people should be held accountable.

    In your biased attacking style you are clearly indicating (and admitting) that there is only one side to this story.

    So in your closed partisan mind, just b/c this is the nephew of a Justice who shares your political views you will not even consider the possibility that this nephew attacked an orderly … or some similar egregious offense.

    The other side of the story is beginning to emerge.

    Mr. Thomas was possibly being hospitalized under a 72-hour-hold following a suicide attempt. He attempted to leave the hospital and this lead to the altercation with security who were attempting to prevent him from leaving and violating the mandatory hold..

    If he was in fact tased, was it justified? That seems to be the key question as this story continues to unfold … also was he beaten or inappropriately mistreated in other ways?

    This is a sad, difficult situation, should they have just let him go so he could kill himself or do they continue to try and prevent him from doing so.

    You cannot protect people from themselves. It’s the little libertarian in me that has that viewpoint. Release him to his relatives or caretakers. Let’s see how well they can save him from himself. I’m very empathetic to the mentally handicapped or disturbed, not so with their relatives who dump them in institutions and expect all their needs to be met.

    Clarence Thomas and fellow arch conservative Justice Scalia were the only dissenters in a 7-2 Supreme Court decision where the Court held that the use of excessive physical force against a prisoner may constitute cruel and unusual punishment even though the inmate does not suffer serious injury.
