Alan Dershowitz Suggests Cohen Could Be in Trouble Over Trump Tape: If He Leaked it, ‘He Has a Serious Problem’

 

Alan Dershowitz thinks the bombshell audio obtained by CNN on Tuesday night of President Donald Trump discussing a payout to Playboy model Karen McDougal with his then-lawyer, Michael Cohen, could spell trouble for one of the parties on that tape.

But not the one you might think.

Appearing on Fox & Friends Wednesday, the Harvard Law professor emeritus said that if Cohen was the original source of the leaked audio (the tape was provided to CNN by Cohen’s lawyer, Lanny Davis), Cohen could have some major issues.

“If in fact this material was originally leaked by Cohen, when it was still privileged — remember, a judicial officer found it to be privileged…only after it was leaked did [Trump lawyer Rudy] Giuliani waive the privilege as to this in order to protect the privilege as to any other possible conversations.

“If Cohen is the source of the leak, he has a serious problem,” Dershowitz said. “But we don’t know who the source of the leak is. That’s one of the things I think we have to get to the bottom of.”

As to the potential implications of the tape for the president?

“This is a big deal about nothing,” Dershowitz said
