UK Publicist on Trial for Indecent Assault Uses Penis Size to Defend Himself
It’s the rare trial where someone openly talks about their penis size, but that’s an angle the defense team of British publicist Max Clifford is going for in his ongoing trial for indecent assault. Seven individuals came forward with allegations of abuse that took place between 1966 and 1984, but the contradictory statements on the size of Clifford’s penis is being exploited as a legal defense.
Richard Horwell QC, Clifford’s barrister, picked up on statements from women who separately testified that Clifford had a “freakishly small penis” and that he had an “enormous” one. He told the jury, “The evidence has established that Mr Clifford has an average sized penis.” And thus began one of the most amazing legal defenses you’ll ever hear:
“When flaccid, it is five and a quarter inches long – certainly not freakishly small, certainly not enormous.
“Not one of the witnesses can be relied upon in this regard. It is the details that have caught out the witnesses.”
“‘Why should these women lie?’ That was a question repeated to you on a number of occasions, as if that point alone was capable of proving the case. The reality is very different,” said Horwell.
Clifford had previously admitted to a bit of “slap and tickle” in his office back then but denied any charges he forced anyone to have sex with him.
