‘Nobody Cares’: Elie Honig Gives Brutal Assessment of Steve Bannon’s Last-Ditch Effort to Delay Prison Sentence

 

CNN legal analyst and former federal prosecutor Elie Honig said the writing is pretty much on the wall for Steve Bannon, who, despite attempts to appeal, will likely have to report to prison on July 1.

Bannon was convicted of contempt of Congress after he refused to comply with a subpoena from the House Jan. 6 select committee investigating the Capitol riot, as well as Donald Trump’s overall attempt to subvert the 2020 election. Last week, a judge ordered Bannon, a former White House adviser to Trump, to report to prison at the beginning of next month. CNN reported on Monday that Bannon will serve his four-month prison sentence at the low-security federal correctional facility in Danbury, Connecticut. Lawyers for Bannon had hoped he would be sent to a minimum-security prison, or a “Club Fed” facility.

Appearing on Monday’s edition of The Source, Honig was asked about Bannon’s attempt to delay the start of his sentence.

“Can I please get your take on what Bannon’s attorneys said in a filing to the D.C. U.S. Circuit Court of Appeals?” host Kaitlan Collins asked of their efforts to delay the sentence. “Basically saying that he shouldn’t have to go to prison July 1 because then he would be behind bars for the four-month period leading up to the election. They said this would effectively bar Mr. Bannon from serving as a meaningful adviser and the ongoing national campaign. Do courts care about that?”

Honig was blunt.

“Nobody cares,” he said. “And it’s not relevant at all. And let me just explain to people why Steve Bannon is out of prison, even as of this moment. So, he was convicted at trial, people will remember. He was sentenced to four months and then he was given the courtesy of bail pending appeal, which means you get to stay out until your appeals are over, so long as you can show you have a substantial chance of winning on appeal. He’s now lost his appeal.”

Honig went on to say Bannon’s only hope is that the full D.C. Circuit agrees to hear his appeal, but “they almost never do that.” He went on to say Bannon could ask for the U.S. Supreme Court to intervene.

“I think that’s extremely longshot too,” Honig added.

Bannon is also scheduled to go on trial in September on state fraud charges in New York and may be held at the infamous Rikers Island jail. He had been indicted on federal charges over the same We Build The Wall scheme, but Trump pardoned him.
