GOP Lawmaker Floats Bizarre Plan to Have AG Garland Taken Into Custody By the House Sergeant at Arms

A House Republican, appearing on Fox News, floated a bizarre plan to Attorney General Merrick Garland taken into custody by the House Sergeant at Arms.

Appearing on Sunday Morning Futures, Rep. Anna Paulina Luna (R-FL) told anchor Maria Bartiromo about her plan to use an obscure provision — which hasn’t been used in more than a century — to enforce the Contempt of Congress resolution it handed down Wednesday against the attorney general. (The DOJ has said it will not prosecute the attorney general.)

“Several months ago, I introduced a resolution for something called Inherent Contempt of Congress. This is something that Congress has the authority to do, and it hasn’t been done since the early 1900’s…I anticipated that the Department of Justice would not do their job. And so I had this teed up and ready to go. I’ve brought this to Speaker [Mike] Johnson’s attention.

“And what that allows Congress to do is really be the punitive arm and really hold Garland accountable by using the Sergeant at Arms to essentially go and get him, as well as the tapes [of President Joe Biden’s testimony in the probe of Special Counsel Robert Hur], bring him to the well of the house and really be a check-and-balance on the Department of Justice.”

Luna insisted that she will push for a vote on her resolution.

“Again, this hasn’t been done since the early 1900s’,” she said. “But that vote will be coming to the floor, and hopefully we will be able to bring some accountability.”
