Kim Davis’ Lawyers Files Emergency Motion to Get Her Released from Jail

 

Screen Shot 2015-09-07 at 5.11.13 PMAttorneys for Kim Davis filed an emergency motion today to get her out of jail and her name off the marriage licenses issued while she’s been in there.

Davis was ordered to go to jail after repeatedly refusing multiple orders to issue gay marriage licenses, including defying the Supreme Court after her appeal there failed.

The emergency motion [PDF] argues that she should be allowed an exemption from the governor’s mandate on issuing gay marriage licenses because of her religious convictions.

In fact, they claim, “The mandate commanding Davis to affix her name to SSM licenses also violates her fundamental free speech rights protected by the United States and Kentucky Constitutions.”

Davis considers it “undue pressure” on her beliefs, and the motion compared her objections to “forcing the religious objecting nurse to perform an abortion… the religious objecting non-combatant to fire on an enemy soldier, or the religious objecting state official to participate in or attend the execution of a convicted prisoner.”
