Lawyer for Knicks’ Derrick Rose Asks Rape Trial Judge to Order Accuser to Stop Crying on the Stand
New York Knicks guard Derrick Rose and two male friends on trial in civil court in Los Angeles, where a woman alleges that the three men raped her in 2013.
According to a courtroom account from Deadspin, the accuser took the stand Thursday, and cried throughout her testimony. At one point, according to the report, a juror asked for the accuser to speak into the microphone — as she was so overcome that the juror was not able to hear her speak.
During a break with the jury out of the courtroom, defense lawyer Michael Monico lodged a complaint about the accuser’s visible emotion.
“Is she going to cry all afternoon?” Monico said.
Judge Michael W. Fitzgerald dismissed the objection.
“I’m not going to order a witness not to cry, any more than order her not to breathe,” Fitzgerald said.
The accuser’s testimony lasted through the day Thursday and is scheduled to resume today.
