The Supreme Court of the United States has upheld a crucial aspect of Obamacare, reports Bloomberg.
The case, King v. Burwell, centered over the phrase “established by the state” in the Affordable Care Act. Conservatives argued that meant that Obamacare subsidies could only be provided by health care exchanges set up by the states, and subsidies for the federal exchange set up by President Barack Obama were illegal. Liberals disagreed, saying the intention of the statute was more important than the actual language.
The Supreme Court sided with the Obama administration. The Court ruled 6 to 3 that the federal health exchange was the linchpin of the law, and without it the law would collapse. Conservative Justices Anthony Kennedy and Chief Justice John Roberts joined the liberal wing of the Court, three years after Roberts helped save the individual mandate from a Commerce Clause challenge.
