Attorney in Eric Garner NYPD Suit Withdraws over Rape Allegation

High profile police brutality lawyer Sanford Rubenstein has withdrawn from the newly-filed $75 million suit by Eric Garner’s family against the NYPD following an accusation of sexual assault, saying he doesn’t want the charges to interfere with the family’s case.

The alleged incident occurred following Reverend Al Sharpton’s 60th birthday party last week. A woman who accompanied Rubenstein back to his Upper East Side apartment said she awoke bleeding and went to the hospital; she told police that Rubenstein had sex with her when she was too intoxicated to consent.

Charges have not yet been filed against Rubenstein, who has denied that any crime took place.

Garner, who was asthmatic, was killed by an NYPD chokehold that was caught on video; the city coroner later ruled the death a homicide. The case has gone to the grand jury.
