Fox & Friends’ Ainsley Earhardt Parrots Trump’s False Claim That He Can’t Fix Child Separation
On Fox & Friends on Tuesday, co-host Ainsley Earhardt took an administration line on the child separation at the southern border, repeating as fact the assertion that the ball is in Congress’ court, not the administration’s.
“Congress has to do something about this,” she said. “It’s really not up to an administration.”
Earhardt is uncritically repeating President Donald Trump, who said last week: “I hate the children being taken away. The Democrats have to change their law. That’s their law.”
This is the line being repeated across all administration outlets, but is simply not correct. The reason so many children are being separated from parents right now is attributable directly to the administration implementing a “zero tolerance” policy of prosecuting as criminal all who attempt to enter the country illegally. That means holding and charging as criminal all “attempted” crossings as well as actual crossings.
This is a change in prosecutorial discretion implemented by Attorney General Jeff Sessions and part of Donald Trump’s border policy. The fact that the separation resulting from those charges would have and did occur under other administrations is a diversion from whether or not the charges were being brought in the first place.
Contrary to Earhardt’s assertion of fact, this actually can be reversed — without Congress — simply by undoing the change made by Sessions in April.
Nevertheless, considering it is a key administration argument, expect other Fox News opinion hosts to repeat it throughout the day.
